Özet
İşsizlik sorunu, taşıdığı çok sayıda sosyo-ekonomik etkisi sebebiyle hükümet programlarının her zaman en önde gelen meselelerinden birisi olmuş ve farklı istihdam politikaları ile işsizliğin bu etkileri azaltılmaya çalışılmıştır. İşsizliğin sadece birey nezdinde değil fakat toplum nezdinde de karşılık bulan sayısız olumsuzluğu, sorunun daima güncel kalmasını sağlamıştır. İşsizliğin sebep olabileceği tüm bu olumsuzlukların önüne geçmek, ideal olan tam istihdamın sağlanması ile mümkün olabilmekte, ancak istihdamın yetersiz kaldığı durumlarda birtakım sorunlar baş gösterebilmektedir. Bu halleriyle işsizlik, toplumca tazmini gereken bir sosyal risk olduğundan, çalışma isteğinde olmasına karşın buna imkân bulamayan kimselerin, belirli bir gelir güvencesine kavuşturulması gerekmektedir. Bu ihtiyaç içerisinde ortaya çıkan ve işçi, işveren ve devletin dayanışmasının güzel bir örneği olan işsizlik sigortası, birtakım şartları taşımaları halinde sigortalı işsizlerin gelir kaybını belli ölçüde karşılama amacı güden ve böylelikle işsizliğin sosyo-ekonomik etkilerini en aza indirgeme işlevi gören bir sosyal sigorta koludur. Günümüzde özellikle 2019 yılı sonlarından itibaren ülkemizi ve dünyamızı önemli ölçüde etkileyen Koronavirüs (Covid-19) salgını sebebiyle işsizlik sigortası önemini hissettirmiş ve bu süreçte yaşanan birtakım gelişmeler, sistemin daha tutarlı planlanması gerektiğini gözler önüne sermiştir. Zira işsizlik sigortası finansmanının kullanımı ve denetimi ile sigortaya hak kazanma koşullarının günümüz şartlarına uygun düşmemesi gibi durumlar karşısında, sistemin ortak iyiyi sağladığından ve işlevini tümüyle yerine getirdiğinden söz etmek güçleşmektedir. O halde ülkemizdeki işsizlik sigortası uygulaması, günün koşullarına uyan ve amacı ile de örtüşen bir şekilde revize edilmelidir. Bu çalışmada da ilk olarak işsizlik ve işsizlik sigortası kavramları üzerinde durulacak, izleyen kısımda işsizlik sigortasının kapsamı, yönetimi ve finansmanı incelenecek, daha sonra işsizlik sigortasına hak kazanma koşulları, hukukumuzda uygulanan işsizlik sigortası yardımları ile ele alınacak, nihayet son kısımda ülkemizdeki sistemde karşılaşılan sorunlar, birtakım istatistiksel veriler ışığında değerlendirilerek sistemin sürdürülebilirliği tartışılacaktır.

The unemployment problem has always been one of the leading issues of government programs due to its large number of socio-economic effects, and they have been tried to be reduced with different employment policies. The numerous negativities of unemployment, not only for the individual but also for the society, have ensured that the problem is always contemporary. Preventing all these negativities that unemployment may cause can be possible by providing full employment, which is ideal, yet some problems may arise when employment is insufficient. In this respect, as unemployment is a risk that needs to be compensated by society, people who cannot find the opportunity to work despite their desire should have a certain income security. Unemployment insurance, which emerged in this need, is a good example of the solidarity of the worker, employer and the state and is a social insurance branch that functions to minimize the socio-economic effects of unemployment by compensating the income loss of the insured unemployed. Today, especially from the last months of 2019, due to Covid-19 epidemic that has affected our country and world, the importance of unemployment insurance has been better understood and some developments in this process have showed that the system needs to be planned more consistently. Since the expenditures and supervision of unemployment insurance and the eligibility conditions for unemployment insurance are not suitable for today's conditions, it is difficult to mention that the system provides the common good and fulfils its function. In that case, the unemployment insurance system in our country should be revised in a way that complies with the current conditions and coincides with its purpose. In this study, firstly the concepts of unemployment and unemployment insurance will be emphasised, in the following section the scope, management and financing of unemployment insurance will be examined, then the eligibility conditions for unemployment insurance will be discussed with the unemployment insurance benefits applied in our law, and finally, in the last part, the problems encountered in the system in our country and the sustainability of the system will be discussed by being evaluated in the light of some statistical data.
