With the recent Serious Fraud Office prosecution to Barclays for the loan taken during the Financial Crisis of 2008 from Qatar, the prohibition on financial assistance became a topic of interest, resurfacing the debates on its complexity. As it is a commercial reality that is integrated to the needs of the economic market and the changing business structures, it is important to clarify whether it is a financial tool that is good for the economy and the investors or an economic crime that would result in hurting the shareholders and the creditors. This research is designed to clarify the meaning and the purpose of the prohibition and although the Barclays case is still on trial, as it will determine the future of this prohibition, a close analysis of the investigation will give a glimpse of how the prohibition can be reformed in the future. Additionally, leveraged buyouts in United States, that operate as a financial tool, and designed by mathematical methods, will be presented as an alternative. The second part of the research will focus on whether the prohibition on public companies hurt the economy through a brief insight into how some of the liberal economic leaders of the world, G20 members, react to the prohibition. Because financial assistance is a very niche topic and is fairly new compared to other company law principals, most of the sources used are journal articles and reports from law firms in addition to statutes, constitution and cases
