Özet
Bu çalışmada necisle tedavi bağlamında domuz örneği incelenmekte, necisle tedavinin zaruret olup olmayacağı yönündeki görüşlere yer verilmektedir. Giriş ve iki bölümden oluşan bu çalışmanın giriş bölümünde araştırmanın konusu, amacı, önemi, yöntemi, kapsamı ve sınırlılıkları ele alınmaktadır. Birinci bölümde konumuzun temelini oluşturan necis, haram ve zaruret kavramlarına değinilmiştir. Ardından domuzun ilahi dinlerdeki yerine kronolojik olarak yer verilmiştir. İkinci Bölümde İslam Hukukunda tedavinin hükmü ele alınmış, necis madde ile tedavi konusunda mezheplerin görüşlerine yer verilmiştir. Necisle tedavinin bir örneği olarak domuzun tedavide kullanılması incelenmiştir. Domuzun tedavide kullanımının ilk örneği olarak öncelikle ilaçlarda kullanılan domuz içerikli maddelere değinilmiştir. Ardından domuzdan insana organ nakli ele alınmıştır. Bu başlık altında domuzdan insana kalp kapakçığı nakli, böbrek nakli ve kalp nakline tıbbi açıdan değinilmiştir. Çalışma necis maddenin tedavide kullanımının bir örneği olan domuzun tedavide kullanımının zaruret olup olmayacağı yönünde değerlendirme ile sonuçlandırılmıştır. Çalışmada dinen necis olarak nitelendirilen domuzun veya domuz içerikli maddelerin tedavide kullanımının tek yöntem haline gelip alternatifinin bulunmaması durumunda zaruret kapsamında değerlendirildiği sonucuna ulaşılmıştır. Tedavide domuzun tercih edilme sebebinin hızlı üretim ve hızlı yavrulamanın sağladığı finansal avantajlar olma ihtimali hakkında net bilgimiz olmamakla birlikte -alternatif maddenin bulunmasına rağmen- bu ihtimalin gerçekleşmesi, bu maddelerin tedavide kullanımını zaruret kapsamından çıkaracağı sonucuna ulaşılmıştır.

In this study, the pig sample is examined in the context of treatment with najis, and opinions on whether treatment with najis is necessary or not are given. In the introduction part of this study, which consists of an introduction and three parts, the subject, purpose, importance, method, scope and limitations of the research are discussed. In the first chapter, the concepts of najis, haram and necessity, which form the basis of our subject, are mentioned. Then, the place of the pig in divine religions is given chronologically. In the second part, the provision of treatment in Islamic Law is discussed, and the views of the sects about treatment with najis substances are given. As an example of najis treatment, the use of pig in the treatment has been examined. As the first example of the use of pigs in treatment, firstly, pig-containing substances used in medicines were mentioned. Then, organ transplantation from pig to human was discussed. Under this title, pig-to-human heart valve transplantation, kidney transplantation and heart transplantation are mentioned in medical terms. The study was concluded by evaluating whether the use of pig, which is an example of the use of najis substance in treatment, will be a necessity in treatment. In the study, it has been determined that the use of pork or pork-containing substances, which are religiously impure, becomes the only method in treatment and is considered within the scope of necessity if there is no alternative. Although we do not have clear information about the possibility that the reason for the preference of pigs in the treatment is the financial advantages of rapid production and rapid calving, İt has been concluded that the realization of this possibility -despite the existence of an alternative substance- will exclude the use of these substances in treatment from the scope of necessity.
