Özet

Bu çalışma, yabancıların hukuki statüsünü Roma, Rus ve Türk hukuk sistemleri çerçevesinde tarihsel ve normatif bir bakış açısıyla incelemektedir. Yabancılık statüsü, her üç hukuk düzeninde de devlet egemenliği, vatandaşlık bağı ve kamu düzeni anlayışıyla yakından ilişkili olup; ikamet, çalışma, mülkiyet, evlenme, sağlık ve adil yargılanma gibi temel hakların kapsamını doğrudan belirlemektedir. Çalışmada Roma Hukuku, yabancıların özel hukuki statüsünü sistematik biçimde ele alan ilk örneklerden biri olarak teorik başlangıç noktası seçilmekte; bu temel üzerinden Rus ve Türk hukukundaki düzenlemeler tarihsel süreklilik ve kopuşlar ekseninde karşılaştırılmaktadır. Birinci bölümde Roma Hukuku'nda toplumsal yapı, statü kavramı ve yabancıların konumu ele alınmaktadır. Roma'da hak ehliyeti; status libertatis, status civitatis ve status familiae üçlemesi üzerinden şekillenmiş, bu statülere bağlı olarak vatandaş–yabancı ayrımı keskinleşmiştir. Ius civile yalnızca Roma vatandaşlarına uygulanırken, genişleyen imparatorluk sınırları ve artan ticaret ilişkileri sonucunda gelişen ius gentium, peregrinilerin hukuki işlemlere katılımını mümkün kılan daha esnek bir alan yaratmıştır. Praetor peregrinus'un ediktleri aracılığıyla yabancıların sözleşme yapma, ticaret yapma ve uyuşmazlıklarını çözdürme imkânları artmış; böylece yabancılar, tam bir vatandaşlık statüsüne sahip olmamakla birlikte, sınırlı da olsa özel hukuki korumadan yararlanabilmiştir. İkinci bölümde Rus hukukunda yabancıların statüsünün tarihsel gelişimi üç dönem halinde incelenmektedir. Çarlık Rusyası döneminde yabancılar, ticaret, sanayi ve eğitim alanlarındaki ihtiyaçlara göre ayrıcalıklı veya sınırlı statülere tabi tutulmuş; mülkiyet edinimi, ikamet ve vatandaşlığa kabul bakımından sıkı şartlar ve bölgesel farklılıklar öngörülmüştür. Sovyetler Birliği döneminde ise sosyalist ideolojinin etkisiyle özel mülkiyet ve serbest piyasa faaliyetlerinin büyük ölçüde ortadan kaldırılması, yabancıların çalışma, yerleşme ve eğitim haklarını son derece daraltmıştır. Yalnızca diplomatik misyon mensupları ve belirli uzman grupları sınırlı haklardan yararlanabilmiştir. Sovyetler Birliği'nin dağılmasını takiben kurulan Rusya Federasyonu'nda 1993 Anayasası ve özellikle 115-FZ sayılı Federal Yasa ile yabancıların ikamet, çalışma, mülkiyet edinme, evlenme, sağlık hizmetlerine erişim ve adil yargılanma hakları daha ayrıntılı biçimde tanımlanmış; ikamet izinleri, çalışma izni–patent sistemi ve yargısal koruma mekanizmaları normatif düzeyde güvence altına alınmıştır. Bununla birlikte göç politikasının güvenlik odaklı uygulanması, bürokratik süreçlerin karmaşıklığı ve ayrımcı uygulama iddiaları, yabancıların fiili hak kullanımında önemli sorunlar doğurmaya devam etmektedir. Üçüncü bölümde Türk hukukunda yabancı kavramı ve yabancıların statüsü, vatandaşlık hukuku, göç hukuku ve insan hakları ekseninde ele alınmaktadır. Öncelikle“yabancı”kavramı; yabancı ülke vatandaşları, vatansızlar, göçmenler, mülteciler ve uluslararası koruma statüsündeki kişiler ile diplomatik temsilciler gibi özel statülü yabancılar yönünden ayrıştırılmakta; bu statülerin her birinin hak ve yükümlülükler üzerinde farklı etkileri olduğu gösterilmektedir. Ardından yabancıların Türkiye'deki ikamet izni rejimi, ikamet izni türleri, ikamet izni–vatandaşlık ilişkisi, sosyal haklara erişim ve uluslararası koruma ile kesişim noktaları bakımından incelenmekte; Danıştay ve Anayasa Mahkemesi kararları ışığında ikamet izinlerinde idarenin takdir yetkisi, gerekçelendirme yükümlülüğü ve yargısal denetimin sınırları tartışılmaktadır. Çalışma izni bakımından ise yabancıların Türkiye'de çalışma hakkının anayasal çerçevesi, çalışma izni türleri, başvuru usulleri, çalışma izninin ikamet, sosyal güvenlik ve iş hukuku ile ilişkisi ile yargı kararlarında çalışma izni uygulamaları analiz edilmekte; özellikle kamu düzeni ve güvenlik gerekçesiyle getirilen sınırlamaların, yabancıların ekonomik ve sosyal hakları üzerindeki etkisi irdelenmektedir. Son olarak yabancıların evlenme hakkı; resmi evlenme usulleri, konsolosluk evlilikleri, kamu düzeni, tanıma–tenfiz ve yabancı evliliklerin geçerliliği bağlamında değerlendirilmekte; Türk mahkemeleri ve uluslararası yargı mercilerinin içtihadı çerçevesinde bireyin aile kurma hakkı ile devletin denetim yetkisi arasındaki denge tartışılmaktadır. Sonuç bölümünde, Roma, Rus ve Türk hukuklarında yabancıların statüsünün yalnızca normatif metinler üzerinden değil; aynı zamanda her dönemin siyasal iklimi, güvenlik anlayışı, ekonomik ihtiyaçları ve göç politikalarıyla birlikte şekillendiği ortaya konulmaktadır. Roma Hukuku'ndaki statüye dayalı hak ehliyeti anlayışı ve ius gentium'un esnek yapısı, modern hukuk sistemlerinde yabancıların statüsünü düzenleyen ilkelere tarihsel bir arka plan sunmaktadır. Rus ve Türk hukukları karşılaştırıldığında ise, yabancıların ikamet, çalışma, mülkiyet, evlenme, sağlık ve adil yargılanma haklarının metin düzeyinde giderek genişlediği, ancak uygulamada bürokratik engeller, güvenlik odaklı yaklaşımlar ve yargı kararlarının sınırlı etkisi nedeniyle bu hakların tam anlamıyla hayata geçirilemediği sonucuna ulaşılmaktadır. Böylece çalışma, yabancı statüsünün evrimini yalnızca teknik bir hukuk tarihi meselesi olarak değil, aynı zamanda siyasal ve toplumsal dönüşüm süreçlerinin bir yansıması olarak ele almaktadır.

This study examines the legal status of foreigners within the Roman, Russian and Turkish legal systems from a historical and normative perspective. The status of foreigners is closely linked, in all three legal orders, to state sovereignty, the bond of citizenship and the concept of public order; it directly determines the scope of fundamental rights such as residence, employment, property, marriage, health and fair trial. In the study, Roman law is chosen as the theoretical starting point as one of the first examples to systematically address the private-law status of foreigners; building on this basis, the regulations in Russian and Turkish law are compared in terms of historical continuity and rupture. The first chapter deals with the social structure, the concept of status and the position of foreigners in Roman law. In Rome, legal capacity was shaped around the tripartite scheme of status libertatis, status civitatis and status familiae, and the distinction between citizen and foreigner became sharper in line with these statuses. While the ius civile applied only to Roman citizens, the ius gentium, which developed as a result of the expanding borders of the Empire and increasing commercial relations, created a more flexible sphere that enabled peregrini to participate in legal transactions. Through the edicts of the praetor peregrinus, the possibilities for foreigners to enter into contracts, engage in trade and resolve their disputes increased; thus, although they did not possess full citizenship status, foreigners were nevertheless able to benefit, albeit to a limited extent, from private-law protection. The second chapter examines the historical development of the status of foreigners in Russian law in three periods. In Tsarist Russia, foreigners were subject to privileged or restricted statuses depending on needs in the fields of trade, industry and education; strict conditions and regional differences were prescribed regarding acquisition of property, residence and admission to citizenship. In the Soviet Union period, the abolition to a large extent of private property and free market activities under the influence of socialist ideology significantly narrowed foreigners' rights to work, settle and receive education. Only members of diplomatic missions and certain groups of experts could benefit from limited rights. Following the dissolution of the Soviet Union, in the Russian Federation established thereafter, the 1993 Constitution and, in particular, Federal Law No. 115-FZ defined in more detail the rights of foreigners to residence, work, acquisition of property, marriage, access to health services and fair trial; residence permits, the work permit–patent system and judicial protection mechanisms were secured at the normative level. However, the security-oriented implementation of migration policy, the complexity of bureaucratic procedures and allegations of discriminatory practices continue to create significant problems in the effective enjoyment of rights by foreigners. The third chapter addresses the concept of“foreigner”and the status of foreigners in Turkish law within the framework of citizenship law, migration law and human rights. First, the concept of“foreigner”is differentiated with respect to foreign nationals, stateless persons, migrants, refugees and persons under international protection, as well as foreigners with special status such as diplomatic representatives; it is demonstrated that each of these statuses has different effects on rights and obligations. This is followed by an examination of the residence permit regime in Turkey, the types of residence permits, the relationship between residence permit and citizenship, access to social rights and the intersections with international protection; in light of decisions of the Council of State and the Constitutional Court, the administration's discretionary power in residence permits, its duty to state reasons and the limits of judicial review are discussed. With regard to work permits, the constitutional framework of foreigners' right to work in Turkey, the types of work permits, application procedures, the relationship of work permits with residence, social security and labour law, and the case law on the implementation of work permits are analysed; in particular, the impact of restrictions imposed on grounds of public order and security on foreigners' economic and social rights is examined. Finally, foreigners' right to marry is evaluated in the context of formal marriage procedures, consular marriages, public order, recognition and enforcement, and the validity of foreign marriages; the balance between the individual's right to found a family and the state's supervisory authority is discussed in light of the case law of Turkish courts and international judicial bodies. In the conclusion, it is shown that the status of foreigners in Roman, Russian and Turkish law is shaped not only by normative texts, but also by the political climate, security perception, economic needs and migration policies of each period. The status-based understanding of legal capacity in Roman law and the flexible structure of the ius gentium provide a historical background for the principles governing the status of foreigners in modern legal systems. When Russian and Turkish law are compared, it is concluded that, although the rights of foreigners to residence, work, property, marriage, health and fair trial have gradually expanded at the textual level, these rights cannot be fully realised in practice due to bureaucratic obstacles, security-oriented approaches and the limited impact of judicial decisions. Thus, the study approaches the evolution of the status of foreigners not merely as a technical question of legal history, but also as a reflection of political and social transformation processes.
