Özet
ÖZET Osmanlı Devletinde ilk döneminden itibaren emniyet hizmetini ifa eden kurumlar ve bu kurumların modern dönemde değişim geçirerek oluşturduğu yeni yapılar konumuzun temelini teşkil edecektir. Bu değişimin başlangıcı olan 1826 yılında Yeniçeriliğin kaldırılması ve takip eden dönemde 1839 yılında başlayan Tanzimat Dönemiyle ortaya çıkan değişiklikler polislik açısından yeni bir dönemin başlangıcı olmuştur. Bu gelişime etki eden faktörlerle gelişimin yönünü açıklamak konumuzun amacım teşkil edecektir. Bu değişimdeki en büyük yenilik hiç şüphesiz hukuki ve adli alandaki yeniliklerdir. Hukuki alanda kanunilik ve kanun önünde eşitlik ilkelerinin ön plana çıkması ve adli olarak da yeni polis yapılan bu yemliklerin en büyük yansımalarıdır. Bu çerçevede 1846'da kurulan Zaptiye Müşiriyeti ve 1881 'den sonra kurulan ve bugünkü polis teşkilatının da kökenini teşkil eden Zaptiye Nezareti hakkında açıklamalar yapılacaktır. Bu yapıların anlaşılabilmesinde emniyet hizmetlerinin hukuka uygun ve modern bir tarzda verilmesi için gerekli olan mevzuatın gelişimi ve diğer kanunların da doğru uygulanması birinci derecede önemlidir. Diğer önemli bir husus olan polisiye hizmetlerin askeriyeden farklı idari yapılar tarafından görülmesi ve bu algılayış tarzının gelişmesi de konumuzda inceleyeceğimiz diğer önemli bit nokta olacaktır, diğer taraftan bunlara paralel olarak gelişen polis mevzuatı ve hukuku da incelenerek bu yapıların Türkiye Cumhuriyeti'ne intikal süreçleri ve günümüz emniyet teşkilatına etkileriyle konumuz sona erecektir.

IV ABSTRACT The organizations that supply the security services from the beginning of the Ottoman State and their new constructions that evoluted in a modern manner will be the basics of this thesis. The start of this evolution, in 1826, the abolution of the Janissarity and in the decade, the changes that occurred with the reforms made in Ottoman State in 1 839, have become the beginning of a new term policeship. With the effects that belong to the changes in administrative construction after The Reforms in 1839 and also the examples in Europe, are the new police constructions built. With the circumstances that effects this evolution, explaining the way of it will become the aim of our subject. The greatest revolutions about this development that came with The Reforms (Tanzimat) are the ones made in law and judgement areas. Especially in law area obtaining importance of principals of the equality in front of law and lawfulness and in security area, building of new police constructions are the indicators of these revolutions. In this context, it will be given information about the Department of Security (Zabtiye Müşiriyeti) established in 1 846 and the Ministry of Security (Zabtiye Nezareti) established in 1881, which also constitutes the base of today's police organization. It is important in first degree that the development of police law needed for performing security service in a convenient and modern way and the right execution of the other codes to be able to understand these constructions. It will be another important point that we will explain in our subject is execution of security duties by a managerial construction except for army and the growth of perceivement style. On the other hand, by examining the police law progressing parallel to these changes, thesis comes to an end with all these constructions' transition process to the Republic of Turkey and their influences to the present security organization.
