Özet
ÖZET Şer'î mahkemelerde kadılar tarafından tutulan Şer'iyye sicilleri, Osmanlı ve dünya tarihinde, ait oldukları dönemin sosyal, iktisadi, idari ve hukuk yapısını aydınlatan en önemli kaynaklardır. Transkripsiyonunu ve değerlendirmesini yaptığımız 29 Numaralı Kütahya Şer'iyye Sicili, Hicri Muharrem 1268- Zilhicce 1269 / Milâdî Ekim 1851 - Eylül 1852 yılları arsında Kütah'yada görülen çeşitli davaları kapsamaktadır. Belgelerin konu ve içerikleri; tereke-miras, idane ve kefalet, temlik ve kefalet, çeşitli konularda mürâsele, ilâm, vasi tayini, vekîl tayini, nazır tayini, tezvic, şukka, nafaka, berât-ı hümâyûn, buyuruldu, ferman ve değişik davalardan oluşmaktadır. Yaptığımız bu çalışma ile Kütahya ve çevresinin; örf ve adetleri, gelenekleri, yer isimleri, şahısların kullandığı isimler ve unvanlar, müslüman olmayan toplulıkların Kütahya'daki yaşantısı ve müslüman halkla ilişkileri rahatlıkla görülebilir. Yine bu belgeler sayesinde toplumun temelini oluşturan aile kurumunun yapısı, aile içinde yaşanan problemlerin niteliği, çok eşli ve tek eşli evliliklerin istatistikleri, miras ve nafaka problemlerinin çözüm şekli (aile huku) öğrenilebilir. Ölen kişilerin mirasçılarına bıraktığı mal varlıklarının ayrıntılı olarak yazılması ve davalara konu olan diğer maddi meselelerle kayıtlarda yazılan meslekler, dönemin Kütahyasındaki iktisadi durumu bize gösterebilir. Kısaca yaptığımız çalışma ile günümüzde önemi gittikçe artan yerel tarih çalışmalarına katkıda bulunmayı amaçlıyoruz.

VI ABSTRACT In Ottoman and the world history, the registers of religious laws, which were kept by the judges in religious law Courts, are the most important sources that enlighten social, economic, administrative and law construction of that term.“The 29th registers religious laws of Kütahya”which is evaluated, includes the various trials that were held between (H.1268 - 1269) and this is about between October, 1851 and September, 1252 A.C. The subject and contents of the documents consist of inheritance, dept anol bail, giving as a property and bail, writing letters to each other about different subjects, formal document that shows the result of the trial, designation of a guardion, designation of a represantative, designation of a minister, marriage, formal writing, alimany, imperial edict (a writing which is written as a command by high authority) and different trials. With this study, the traditions, usage and customs of Kütahya and its environment, the place names, the names and titles that were used by individuals, the life of communities who were not muslim in Kütahya and their relations with muslim people can be seen easily. In addition to this, with the help of these documents, the construction of family which forms the basis of society, the quality of the problems that takes place in the family, the statistics of poligamy and monopoly, the solution way of the problems of inheritance and glimony (family law) can be learnt. Writing of the good which are left to inheritors by the dead person in detail and the occupations which were registered with the other problems which were the subject of the trials can give us information about the economic condition of that term in Kütahya. Briefly, with this study it's aimed to add something to local history studies which gain importance gradually today.
