The Declaration on the right to development set forth the principles concerning the economic, social and political process of development in general terms. Therefore, among scholars and states there are three opinions on its legal statue: whether it is the political aspirations of states, an emerging right or a fully realisable legal right. To respond to these controversies, the paper will explore the substance of the Declaration and demonstrate how it should be interpreted. In this regard, it has been pointed out that the respect for human rights in the development process and ensuring die individuals' participation to it or generating international cooperation as a means to supplement the efforts of the governments are the core obligations incumbent upon states. Equally, the human rights-based approach to development requires the fulfilment of human rights as a means and an end of the development. Therefore, raising people's living standards and enlarging their capabilities should be the main aim of development policies. However, it has been observed that in the current situation this approach has yet to be adopted by the international economic institutions. Since redressing economic inequalities and creating favourable economic conditions for nations' development is at the heart of the right to development, the WTO and its role in regulating the international world trading has been investigated to discuss to what extent the international economic order is compatible with the right to development. It has deduced that the policies of the WTO do not leave room for states to accomplish their development goals, therefore rethinking the priorities is urgentiy needed in international economic relations. The implementation of the right to development requires a strong political determination from all states and obtaining this is considerably difficult in the world of today. Yet, the UN initiative for the 8 Millennium Goals is a promising step forward towards launching global parmerships and development compacts. For this reason, we believe that the principles in the Declaration can be transformed into concrete actions and the emerging right to development can be gradually realised for ensuring the well-being of people all around the world.
