Each year, hundreds of thousands of people in different corners of the world are forcibly uprooted within their own countries by violent conflicts, natural disasters, gross violations of human rights or other traumatic events. IDPs outnumber refugees by far, and they also raise some of the most urgent human rights and humanitarian problems of our time. Usually there are multiple, overlapping and interrelated reasons explaining displacement such as natural disasters, man-made disasters (nuclear or chemical accidents), development projects (dam construction), armed conflict, state collapse, complicated political environments and internal strife. In some cases, the causes of displacement seemed to be a pretext for the displacement of political opponents. Of the world's population at risk, IDPs tend to be among the most desperate and are easy targets for sexual assaults, arbitrary detention, ethnic cleansing or physical violence and the highest mortality rates ever recorded during humanitarian emergencies have involved IDPs. Like refugees, IDPs have been forced to leave their homes; unlike refugees, they remain within the borders of their own countries. Those who are forced from their homes for more or less the same reasons as refugees but who remain under the jurisdictions of their own governments are excluded from international protection. In order to define the rights of IDPs and the responsibilities of governments and the international community towards them, the development of a legal framework for IDPs became one of the main tasks of the UN. It appears that the protection afforded to IDPs under current international law may not be adequate and this is why Guiding Principles on Internal Displacement were drafted. Whereas drafting guiding principles fills the gaps in existing legal norms, there is still limited impact on ensuring accountability due to their non-binding nature. They became the only internationally endorsed document that systematically tackles the problems of IDPs. The objective of this research is to clarify whether the protection afforded to IDPs under the GPs is adequate. The study will focus on the legal significance and the implementation of the GPs. It is the objective of this research to provide a comprehensive study on the strengths and weaknesses of the GPs and to examine how effective these principles are in terms of their non-binding nature. It also explores the ways that may reinforce IDP protection and assistance in the existing international law.
