Özet
Çalışmamızın konusu, 6102 Sayılı Türk Ticaret Kanunu'na göre acentelik sözleşmesinin sona ermesi ve sona ermenin sonuçları. Tez, giriş ve sonuç dışında, üç bölümden oluşmaktadır. Birinci bölümde, öncelikle Acentenin Alman ve Türk hukukundaki tarihçesine değinilip, sonrasında ise acente ve acentelik sözleşmesine ilişkin genel bilgilere yer verilmektedir. Bu çerçevede, acentenin tanımı, unsurları, tacir niteliği ve türleri incelenmektedir. Sonrasında acentelik sözleşmesinin hukuki niteliği ve hükümleri ele alınmaktadır. Devamında acentenin yetkileri ve acentelik sözleşmesinin kendisine yakın sözleşmelerle olan farklılıkları tespit edilmektedir. Bu bölümün sonunda da uygulanacak hükümler ve acentelik hakkındaki hükümlere tabi tutulan diğer hukuki ilişkiler ortaya konulmaktadır. Tezin ikinci bölümünde, genel anlamda acentelik sözleşmesinin sona ermesi ve sona erme nedenleri incelenmektedir. Son bölümde ise, sona ermenin sonuçları başlığı altında, acentenin temsil yetkisinin sona ermesine ve sona erme halinde acentenin haklarına yer verilmektedir. Bu kapsamda, acentenin ücret isteme, hapis ve tazminat haklarına değinilip, Yeni Türk Ticaret Kanunu ile hükme bağlanmış olan denkleştirme istemi ayrıntılarıyla incelenmektedir. Çalışmamızın en son kısmında, sona erme durumunda gündeme gelebilecek ve Türk Ticaret Kanunu ile yeni düzenlenmiş olan rekabet yasağı anlaşmasına yer verilmektedir. Çalışmamızda Türk hukuku temel alınarak ve konuların el verdiğince Alman Hukuku ile karşılaştırılarak, 6102 sayılı Yeni Türk Ticaret Kanunu kapsamında, gerek doktrin görüşlerinden gerekse yargı kararlarından yararlanarak, acentelik sözleşmesinin sona ermesine ve sona ermesinin hüküm ve sonuçlarına ilişkin bir değerlendirme yapılmaktadır.

The subject of the thesis is“ACCORDING TO THE TURKISH COMMERCIAL CODE NO. 6102 THE END OF THE AGENCY AGREEMENT AND THE RESULTS OF THE END”. The thesis, apart from the introduction and conclusion, consists of three parts. In the first part, the history of agency in German and Turkish law and general information about agencies and agency agreements are given. In this context, the definition of agent, elements, attributes and types of traders are analyzed. After this, the legal framework of the agency agreement and its provisions are addressed. Agent 's authority and the differences between similar contracts of agency agreements are identified. In the end of this part, applicable provisions and other legal relations where the provisions of agency are used are emphasized. In the second part, the end of the agency agreement and the reasons for the end in general are studied. In the last part, under the title of the results of the end, the termination of the authorized representative of the agency and the rights of the agency in the case of the end are shown. In this context, the agency's right to charge, imprisonment and compensation rights are mentioned and“the right to compensation”which is stipulated by the new Turkish Commercial Code No. 6102 is examined. The last part of the thesis is“the non-compete agreement”, which is also stipulated by the new Turkish Commercial Code No. 6102 and may come up in case of termination. Turkish law is the basis of the thesis and, in appropriate cases, a comparison with German law is made. In the context of the new Turkish Commercial Code No. 6102, based on judicial and doctrine decisions, an evaluation about the end of the agency agreement and the results of the end is made.
