Özet

Fıkıh usulü ilminin mahiyeti, bu alandaki bir metnin muhtevasının, değişime çok az müsait belli birtakım malumattan ibaret olması gerekeceği çıkarımına imkân vermesine karşın; bu ilmin edebiyatında, metin merkezli telifler, sayı ve itibar yönüyle önemli bir dereceyi haiz durumdadır. Üç bölümden müteşekkil bu çalışma, fıkıh usulü metnine şerh katkısını bir örnek çizgide belirleme isteğindedir. Bu yolla, -en azından bu ilim dalında- şerhin varlığı ve gereği ile metin-şerh ilişkisi bağlamında kullanılabilecek birtakım örnekli ve temelli verilerin üretilmesi amaçlanmaktadır. İlk bölümde, fıkıh usulü için bir telif tarihçesi oluşturulmuş; metin ve ilişkili diğer telifler, tür ve biçim bakımından tanıtılmıştır. Akabinde, bu çalışmanın merkeze aldığı metin ve şerh ile bunların müellifleri hakkında bilinenler, tenkitli bir özet hâlinde sunulmuştur. İkinci bölümde, şerhin metne biçimsel katkıları; tanıtma, tanımlama, örnekleme, sınırlama, tamamlama, detaylandırma, düzenleme, temellendirme, irtibatlandırma, tercih ve tevil etme, eleştirme, doğrulama ve düzeltme ile gerekçelendirme başlıkları altında tasnif ve tahlil edilmiştir. Son bölüm, metnin muhtevasına yönelik şerh katkısını örneklemek içindir. Burada İbn Melek'in, Menârü'l-envâr'ın tamamındaki katkısı ortaya konulduktan sonra; bu metinle bir biçimde irtibatlı çeşitli türden birçok telifin de 'hurumat' alanındaki katkıları gösterilmiştir.

Although the nature of the discipline of Islamic jurisprudence implies that the text of this discipline has to consist of some stable and unchangeable information, it is known that the text-centered works have important place in the literature of Islamic jurisprudence with regard to both quantity and respectability. This dissertation, which has three chapters, aims to show the contribution of the commentaries on a text of Islamic jurisprudence focusing on a text-commentary tradition. Through this examination, the nature of the commentary and its relationship with the text will be clarified on the bases of the examples at least in a single discipline, i.e., Islamic jurisprudence. In the first chapter, after introducing a brief history of the literature of Islamic jurisprudence, text and the relevant styles of compilation are examined. Then the text, its commentaries, which are studied in this dissertation as a case, and their authors are taken up comprehensively. The second chapter of the dissertation focuses on the contributions of the commentary on the text with these sub-titles: description, definition, sampling, restriction, completion, elaboration, regulation, legitimization, association, election and interpretation, criticizing, verification, correction, and justification. The last chapter is assigned to show the contributions of the commentaries to the text through the examples. To achieve this target, first Ibn Malak's contributions to the Manār al-anwār as a whole are scrutinized, and then other works that are somehow relevant with this text from different types are examined on the basis of their sections on the“forbidden things”(ḥurumāt) to present their contributions to the text.
