Özet
Kâsânî'nin furû' fıkha ait olan Bedâi'u's-Sanâi' fî Tertîbi'ş-Şerâi' adlı eseri bağlamında fıkıh usûlüne ilişkin görüşlerini tespit etmeyi hedeflediğimiz bu çalışmamız, Giriş, Üç Bölüm ve Sonuç'tan oluşmaktadır. Giriş bölümü iki kısımda işlenmekte olup ilk kısmında tezin amacı ve yöntemi hakkında bilgi verilirken, ikinci kısmında Kâsânî'nin hayatı ve eseri hakkında bilgiler verilmektedir. Birinci Bölüm'de Kâsânî'nin hüküm ve hükümlerin gayelerine bakışı işlenmektedir. İkinci Bölüm'de hükmün kaynakları hakkında görüşler ele alınıp eserde bunları ne şekilde kullandığına dair bilgi verilmektedir. Üçüncü Bölüm'de Kâsânî'nin nasslardan hüküm çıkarırken nasıl bir usûl takip ettiği, ictihâd ve taklid hakkındaki görüşleri, eserinde geçen görüşlerden ne şekilde tercihte bulunduğu ve onun tevakkuf kavramını kullanımı ele alınarak işlenmektedir. Sonuç bölümünde ise genel bir değerlendirme yapılmaktadır.

This work aims to discuss Kâsânî's views on the principles of Islamic jurisprudence in the context of his titled work Bedâi'u's-Sanâi'. It consists of an introduction, three chapters, and a conclusion. The introduction section has two parts whereby the first part provides information about the aim and the method of the thesis, and the second part gives information about the life and work of Kâsânî. The first chapter discusses Kasani's perspectives on the provision and the objectives of the provisions. The second chapter discusses the opinions about the sources of the provision, and provides information about how he used them in his work. The third chapter discusses what kind of a method Kasanî followed while making a provision from the nass, his views on ijtihad and taqlid, how he made decisions about the opinions mentioned in his work, and finally his use of the concept of tevakkuf. In the conclusion chapter, an overall discussion and an evaluation are presented.
