Özet
Bu çalışma, Osmanlı Devleti'nin çok mezhepli bir yapıya sahip olan Cebel-i Lübnan'da kurduğu idari yapı ile siyasi sistemin yanı sıra, hukuki yapısını oluşturan dini ideolojinin ve daha dar kapsamda Hanefi ekolünün bölgedeki işlevi üzerine inşa edilmiştir. Araştırmada Cebel-i Lübnan'ın iki önemli mezhep grubu olan Şii Dürziler ile Katolik Marunilerin hukuki statüleri incelenmekte, mezhep siyasetinin XIX. yüzyılda bu iki cemaat üzerindeki dönüşümü hukuk çerçevesi üzerinden ele alınmaktadır. XIX. yüzyılın gerek Osmanlı Devleti'nin Tanzimat ve Islahat Fermanı sonrasında reformist dönüşümüne gerekse de Dürzi ve Marunilerin siyasi mücadelelerine tanıklık etmesi, Cebel-i Lübnan'daki hukuki sistem üzerinde yapılan önemli değişiklikleri anlamak açısından önem arz etmektedir. Bu bağlamda yüzyılın ortalarından itibaren, devletin Dürzi ve Marunilere karşı adli sisteminde farklı uygulamaları tercih etmesi, cemaatlerin hukuk-kimlik ilişkisi içinde kendilerini yeniden tanımlama çabalarına yol açmıştır. Araştırmada Osmanlı Devleti'nin bölgedeki hukuki uygulamalara yönelik politikasını oluşturan amiller ele alınmakla birlikte, siyasi gelişmeler ile uluslararası nüfuz mücadelelerinin bölgedeki mezheplerin hukuki yapıları üzerindeki etkisi ve devletin bu gelişmeler karşısındaki yaklaşımını ortaya koymak hedeflenmektedir.

This study is based on the administrative structure of the Ottoman Empire and its political structure, as well as the religious structure which form its legal structure and the Hanafi school in the region. In this study, the legal status of Shia Druzes and Catholic Maronites, two important sect groups of Mount Lebanon, are examined. In the XIX. century, the transformation of these two communities is handled within the framework of the law. The fact that XIX. century witnessed reformist transformation of the Ottoman Empire after the Tanzimat and Islahat Edict and the political struggles of the Druze and Maronites are important in terms of understanding the important changes made on the legal system in Mount Lebanon. In this context, since the middle of the century, the efforts of the communities to redefine themselves in the framework of law-identity have led the State to prefer different practices in the judicial system against Druze and Maronites. The aim of this study is to examine the effects of political developments and international influence on the legal structures of sects in the region and the State's approach to these developments.
