Özet
Bu çalışmada“Nisa Suresi 105-115. âyetlerin İslâm Hukuku Açısından Yorumu”konusu incelenmiş olup söz konusu âyetlerin sebeb-i nüzûlleriyle ilgili rivâyetlerin, müfessirler tarafından nasıl değerlendirildikleri ve bu âyetlerin yorumlarından çıkan fıkhî hükümler mercek altına alınmıştır. Ayrıca söz konusu âyetlerin, yargılama hukuku ve fıkıh usûlü ile ilişkisi de konumuzun kapsamı içerisindedir. Giriş ve sonuç ile birlikte üç bölümden meydana gelen bu çalışmanın giriş kısmında araştırmanın konusu, amacı, yöntemi ve kaynakları üzerinde durulmuştur. Birinci bölümde önce Kur'an-ı Kerim'i anlamada esbâb-ı nüzûlün önemi ele alınmış olup ilgili âyetlerin meali ve tefsiriyle birlikte iniş sebebine dair rivâyetlere yer verilmiş, sonra da Medine'nin sosyal ve dini yapısı tanıtılmıştır. İkinci bölümde söz konusu âyetlerden çıkan yargılamaya dair fıkhî genel hükümlere temas edilmiştir. Üçüncü bölümde ise ilgili âyetlerin fıkıh usûlü ile ilişkisi ele alınmıştır. Sonuçta mezkûr âyetlerin yargılama hukuku alanında normatif kurallar içeren birçok hükme esas teşkil ettiği tespit edilmiştir. Aynı şekilde fıkıh usûlü alanında da bazı delillerin temellendirilmesinde referans alındığı görülmüştür.

In this study, the subject of review is“Interpretation of Surah 4, Nisa, Verses 105-115 in the context of Islamic Law”, and how the related narratives to reasons for landing these verses are analyzed by Mufassirs (commentators) and jurisprudential decrees resulted from their interpretations are scrutinized. In addition, the relationship of the verses with procedural law and fiqh procedures is also covered here. This paper consists of three sections including introduction and conclusion, and the research topic is dwelled on as well as its aim, methodology and resources in introductory paragraph. In the first section, the importance of reasons for landing is initially described in understanding the Quran, and with the meaning and comments of the related verses the narratives concerning their reason for landing are presented,, and subsequently the social and religious structure of the city of Madinah are introduced. In the second section, general principles of jurisdiction based on Our'an verses are mentioned. In the third section, the relationship between the specified verses and the jurisdictional procedures is discussed. In the conclusion part, it was found that the mentioned verses are essential for several decisions with normative rules in procedural law, being taken as a reference to found some evidence.
