Özet
Tezimizin konusunu oluşturan“Ceza İnfaz Kurumuna veya Tutukevine Yasak Eşya Sokmak”suçu,“Millete ve Devlete Karşı Suçlar ve Son Hükümler”kısmında“Adliyeye Karşı Suçlar”isimli ikinci bölüm altında 5237 Sayılı Türk Ceza Kanunu'nun 297.maddesinde düzenlenmiştir. Çalışmamızın konusunu oluşturan suç ile amaçlanan ceza infaz kurumları ve tutukevlerindeki hükümlü ve tutukluların ceza infaz kurumu veya tutukevinde yaşam hakları ile beden ve ruh bütünlüklerini korumak için her türlü koruyucu tedbirin, güvenlik önleminin etkin bir biçimde uygulanmasının ve ceza infaz sisteminin düzen, disiplin ve güven çerçevesinde işleyişinin sağlanmasıdır. Çalışmamız iki bölümden oluşmakta olup ilk bölümde infaz kurumuna veya tutukevine yasak eşya sokma suçu, suçun unsurları açısından incelenmiş, bu suça yönelik kanunen öngörülen yaptırım ve görevli mahkemeye yer verilmiştir. İkinci bölümde ise infaz kurumuna veya tutukevine yasak eşya sokma suçuna ilişkin madde metninde yapılan değişiklikler ve bu suç açısından kanunen öngörülen özel içtima hali ve bu düzenleme sebebiyle uygulamada ortaya çıkan sorunlar ele alınmıştır.

The offence ''Smuggling prohibited items into penal institutions or prisons'' the topic of thesis, is regulated in the section''Offences Against the Nation and the State and Final Provisions'', under the second paragraph ''Offences Against the Administration of Justice'' of article 297 of the Penal Code of the Republic of Turkey Nr. 5237. The intent and purpose of the offence that constitutes the subject of thesis, is the effectively implementation of the protective, safety measure in order to protect the right to life and the body and soul integrity of the unconvicted and convicted prisoners in the penal institutions or prisons, and to ensure the regular functioning of the penal system within the framework of discipline and security. This thesis consists of two main parts. The first part analyses the offence smuggling of prohibited items into penal institutions or prisons with regard to elements of crime, the sanctions prescribed by law and the competent court. The second part is devoted to the changes in the article about the offence smuggling of prohibited items into penal institutions or prisons, the special aggregation with regard to this offence and the application problems caused by this regulation.
