Özet
Karteller rekabet hukukundaki en ağır ihlal türleri olarak değerlendirilmektedir. Türk hukuk sisteminde, karteller karşılığında uygulanacak yaptırımların idari para cezası olarak belirlendiği görülmektedir. Tez çalışmasının amacı, kartel kabahatinin kabahatler hukukunun genel hükümleri ile ilişkisini tespit etmek ve kabahat genel teorisi çerçevesinde unsurlarına ayırarak incelemektir. Çalışma kapsamında; rekabet kavramı, rekabet hukukunun amacı ve işlevi, rekabet hukukunun kaynakları, diğer disiplin ve hukuk dalları ile ilişkisi ortaya konulmuştur. Kabahat kavramı ve rekabet ihlallerinin kabahat niteliği açıklandıktan sonra, kabahatler hukukunun genel hükümleri kapsamında değerlendirmelere yer verilmiştir. Ardından kartele neden olan eylemler, kabahat genel teorisi çerçevesinde unsurlarına ayrılarak incelenmiştir. Ancak bu inceleme, kartel kabahatinin niteliğine uygun düştüğü ölçüde yapılmıştır. Bir kabahat olarak kartele neden olan eylemlerin, diğer tüm kabahatler bakımından da geçerli olduğu gibi ceza hukukunun kavram ve ilkelerinden bağımsız olarak düşünülmesi mümkün değildir. Dolayısıyla çalışma boyunca, ceza hukukunun genel hükümleri ve ilkeleri ile suç genel teorisi çerçevesinde de açıklamalara yer verilmiştir.

Cartels are evaluated as the most serious violations of competition law. In Turkish legal system, it is seen that imposition of administrative fine is stipulated as a sanction against cartels. The aim of this dissertation study is to identify the relation between the cartel misdemeanor and the general provisions of misdemeanor law and to examine this misdemeanor by distinguishing its elements within the framework of the general theory of misdemeanor. In the scope of the study, the concept of competition, the aim and the function of competition law, the sources of competition law and its relation with other disciplines and fields of law are presented. After explaining the concept of misdemeanor and the qualification of competition violations as a misdemeanor, evaluations are made within the scope of the general provisions of misdemeanor law. Subsequently, the acts causing cartel are examined by distinguishing their elements within the framework of the general theory of misdemeanor. However, this examination are made to the extent applicable for the cartel misdemeanor. It is not possible to consider the acts causing cartel as a misdemeanor separately from the concepts and principles of criminal law which is also relevant with regard to all other misdemeanors. Hence, the explanations within the framework of general provisions and principles of criminal law and the general theory of crime are also given.
