Özet
Şâfiî mezhebinde mezhep içi tercih işleyişini konu edinen bu çalışma giriş, sonuç ve üç bölümden oluşmaktadır. Giriş kısmında araştırmanın konusu, amacı, kaynakları ve yöntemi ele alınmıştır. Bunun yanı sıra çalışmayla ilgili olan gerek Türkçe gerekse Arapça literatür hakkında detaylı bilgiler verilmeye çalışılmıştır. Mezhep içi tercihin mahiyetini ortaya koymayı hedefleyen birinci bölümde öncelikle mezhep içi tercihin tanımı, çeşitleri, başlangıcı ve sürekliliği incelenmiştir. Daha sonra ise tercihin unsurları, konusu, amacı ile tercih sebepleri ve diğer fıkhî istidlâl yöntemleriyle olan ilişkisi irdelenmiştir. İkinci bölümde mezhep içi tercihin gerekliliği ve râcih görüşün bağlayıcılığı meselesi müçtehit müftî, mukallid müftî ve müsteftî açısından ayrı ayrı incelenerek konunun daha iyi anlaşılması amaçlanmıştır. Üçüncü bölümde mezhep içi tercih usûlünün mahiyeti; konusu, gayesi ve muhatabı çerçevesinde ele alınmıştır. Özellikle bu usûlün konusu içerisinde yer alan şahıs ve eser merkezli tercih ilkeleri ayrı bir öneme sahiptir. Zira şahıs merkezli tercihte başta İmam Şâfiî'nin farklı kavilleri ile mezhebe mensup diğer müçtehitlerin farklı görüşleri arasında uygulanacak tercih kriterleri önem arz etmektedir. Eser merkezli tercih ilkelerinde de aynı durum söz konusudur. Çalışmanın sonuç kısmında ise ulaşılan tespitler ortaya konmuştur.

This study, which deals with the intra-sectarian preference process in the Shafi'i sect, consists of introduction, conclusion and three parts. In the introduction part, the subject, purpose, sources and method of the research have been discussed. In addition to this, detailed information about both Turkish and Arabic literature related to the study has been tried to be given. In the first chapter, which aims to reveal the nature of intra-sectarian preference, first of all, the definition, types, beginning and continuity of intra-sectarian preference have been examined. Then, the elements of preference, its subject, purpose, reasons for preference and its relationship with other fiqh inference methods have been examined. In the second part, it has been aimed to understand the subject better by examining the necessity of intra-sectarian preference and the bindingness of the preferred opinion in terms of mujtahid mufti, mukallid mufti and mustafti. In the third chapter, the nature, subject, aim and addressee of the intra-sectarian preference method have been discussed. In particular, the preference principles based on the person and the work, which are included in the subject of this procedure, have a special importance. Because in person-centered preference, preference criteria to be applied between different opinions of Imam Shafii and other mujtahids belonging to the sect are important. And also there is same situation in the work-centered preference principles. In the conclusion part of the study, the findings reached have been revealed.
