Özet

在专利历史的早期,专利申请仅接受形式审查,在后期阶段,开始进行新颖性搜索, 最后,专利法引入了创造性步骤标准,目前,所有专利制度都对专利申请进行了严格 的审查程序。除某些地区的某些实用新型外的其他专利申请。 特别是在2000年代专利申请数量迅速增长之后,这导致工作量繁重,审查资源不足, 积压的商品,等待时间很长,结果,专利局开始进行非常快速的检索和审查程序,导 致检索和审查的程序减少即使不符合可专利性标准的高质量专利也会被授予。 专利局以及研究人员和学者已经意识到,这种导致专利质量低下的低质素审查正在损 害社会的创新和福祉,因此对专利质量的研究和辩论增加了,专利局开始更加关注专 利质量。结果,专利局开始看到质量政策,质量管理体系,甚至关于专利审查的ISO 9001标准。此外,专利局最近开始研究人工智能,以使专利审查更加有效。这样,所 有专利审查将由计算机完成,专利质量将比以往更高。 研究还给出了专利质量和专利审查质量的定义,并提出了它们的异同和相互影响,并 比较了EPO和中国的一些实用程序。 关键词:专利质量,审查质量,比较,EPO,中国

Özet (Çeviri)

In the early period of patent history, patent applications were subject to the formality examination only, on later stages a novelty search was started to be conducted and finally inventive step criteria is brought by the patent laws and currently all the patent systems are having substantial examination procedures for the patent applications except some utility models in some territories. Especially after the 2000s patent application numbers have grown very rapidly and this led to heavy workload, insufficient resources for examination, huge backlogs, very long pending times and as a result, patent offices started to conduct very fast search and examination procedures which led to low quality patents which are granted even they don't meet the patentable criteria. Patent offices as well as researchers and scholars have become aware that this low quality examination which results in low quality patents are harming the innovation and welfare of the society so studies and debates on patent quality increased and patent offices started to have more concern about the patent quality. As a result, quality policies, quality management systems and even ISO 9001 standards on patent examination started to be seen in patent offices. Moreover, patent offices recently started studying on artificial intelligence to make patent examination more effective. In this way all the patent examination will be done by computers and patent quality will be higher than ever. The study also gives a definition of the patent quality and patent examination quality and put forward their differences and similarities and how they affect each other and the study also compares some practical procedures in EPO and China
