Özet

This master's thesis aims to analyze the in-app purchasing systems from the perspective of competition law by considering whether the app market should be regulated or not. Even though the in-app purchase systems are beneficial for every participant of app market transactions, the restrictive rules of those systems can be problematic in terms of competition. Such rules may cause i) restrictions on users' choices, ii) a margin squeeze, and iii) refusal of the accessing personal data of users. Although app market operators argue that the idea behind their conduct is security concerns, more than this claim has to be shown to the competition authorities. As a result of consideration of regulations in both EU and the US, it is detected that the Digital Markets Act and the Open App Markets Act provide solutions for the IAP-based competitive problems except for the margin squeeze. Due to the fact the scope of these regulations, however, there are differences in terms of enforcement. Undoubtedly, the app market environment would require to be regulated by sector-specific regulations which have an ex ante structure. In this regard, envisaging a sufficient number of fines and increasing sectoral knowledge of the authorities is quite necessary in order to get better consequences.
