Özet
Askerî düzen, disiplin üzerine kurulmuştur. Disiplin ise ancak emre mutlak itaat ile sağlanacaktır. Bu sebeple her türlü askerî vazifenin ve hizmetin nâzımı olan emir kavramı ve emre itaatsizliğin sonuçları yurt dışından gelecek tehdit ve tehlikelere karşı Türk vatanını savunma, Cumhuriyeti koruma görevini üstlenen, vatanın istinatgâhı Türk Silahlı Kuvvetleri açısından büyük önem arz etmektedir. Bu kapsamda çalışmada, emre itaatsizlik fiilleri sonucu oluşan emre itaatsizlikte ısrar suçu ve emre itaatsizlik disiplinsizliği/disiplin suçu, ağırlıklı olarak Askerî Yargıtay olmak üzere Yargıtay, Askerî Yüksek İdare Mahkemesi, Danıştay, bölge idare ve bölge adliye mahkemelerinin içtihatları ışığında incelenmiştir.

Military order is founded on discipline. Discipline will only be achieved with absolute obedience to the order. For that reason, the concept of order and the consequences of disobedience to orders, which are the basis of all military duties and services, are of great importance for the Turkish Armed Forces, which undertakes the task of defending the Turkish homeland and protecting the Republic against threats and dangers from abroad. In this context; in that study, the crime of insisting on disobedience and disobedience/discipline crime resulting from acts of disobedience are examined in the light of the jurisprudence of the Court of Cassation, the Supreme Military Administrative Court, the Council of State, the Regional Administrative and Regional Courts of Appeal, mainly the Military Court of Cassation.
