Özet
Bu çalışmada, Kenzü'd-deḳāʾiḳ'in en önemli şerhlerinden birisini kaleme alan Zeylaî'nin, Tebyînü'l-hakâʾik adlı eserinde bey' bölümü bağlamında takip ettiği yöntemin tahlili yapılmıştır. Konu genel hatlarıyla bir giriş ve üç bölüm olmak üzere işlenmiştir. Tezin birinci bölümünde, Zeylaî'nin yaşamış olduğu coğrafya ve döneminin kendisi ve eseri üzerinde etkisinin olduğu açıklığa kavuşturulmuştur. Çalışmanın bu bölümünde Tebyîn eserinin muhtevasından hareketle Zeylaî'nin fakihlik yönü, Tebyîn'in kaynakları ve yazılış amacı incelenmiştir. Çalışmamızda Tebyîn'de takip edilen usul ve yöntem incelenerek Zeylaî'nin şerh metodu ortaya konmuştur. Böylelikle onun, Kenz metninde geçen hükümleri nasıl temellendirdiği daha anlaşılır bir seviyede aktarılmıştır. Zeylaî, Tebyîn'de sadece Kenz metninde olan hükümleri açıklamakla yetinmemiş bunun yanında metinde olmayan fakat metindeki hükümle ilişkili bazı yeni hükümler ilave etmiştir. Zeylaî'nin hükümleri temellendirirken hangi istidlâl yöntemlerini nasıl kullandığı, Zeylaî'nin istidlâl kavramıyla neyi kastettiği, Hanefî mezhebi içerisinde yer alan ihtilaflar karşısındaki tutumu ve onun Hanefî mezhebi içerisinde tercih ehli sayılabileceği meselesi örnekler üzerinden açığa çıkarılmaya çalışılmıştır. Zeylaî'nin mezhep içerisinde vuku bulan ihtilaflar karşısındaki tutumu incelenmiş ve onun genellikle Kenz metninde geçen hükümleri tercih ettiği bazı meselelerde ise metinde gecen hükmü tercih etmeyip ihtilaflı görüşlerden birisini tercih ettiği tesbit edilmiştir. Çalışmamızda ayrıca Tebyîn eserinin etkisi gerek Osmanlı Hanefî fakihlerin telif ettiği eserlerde gerek diğer coğrafyalarda yaşayan Hanefî fakihlerin telif ettiği eserlerde görüldüğü ortaya konmuştur.

In this study, an analysis of the method followed by Zaylai, who wrote one of the most important commentaries of Kenzu'd-dekaik in the context of the bey' section in his work called Tebyinul-hakaʾik, was made. The subject is processed in general lines as one entry and three sections. In the first part of the thesis, it was clarified that the geography and period in which Zaylai lived had an effect on him and his work. In this part of the study, based on the content of Tebyin's (the prophets' revealing the commands and prohibitions of Allah) work, Zaylai's scholarship side, Tebyin's sources and the purpose of writing were examined. In our study, the procedure and method followed in Tebyin were examined and Zaylai's interpretation method was revealed.Thus, how he bases the provisions mentioned in the Kenz (all kinds of goods that are subject to alms and whose alms is not given) text has been conveyed at a more understandable level. Zaylai did not content himself with explaining only the provisions contained in the text of Kenz in Tebyin, but also added some new provisions that were not included in the text but related to the provision in the text. It has been tried to reveal which methods of Istidlal (deduction) Zaylai uses when basing the provisions, what Zaylai means by the concept of Istidlal, his attitude towards the disputes within the Hanafi sect and the issue of whether he can be considered the consulted one within the Hanafi sect through examples. Zaylai's attitude towards the disputes occurring within the sect was examined and it was found that he usually prefers the provisions in the Kenz text, while in some issues he prefers the provision in the text and prefers one of the conflicting opinions. In our study, it has also been revealed that the influence of Tebyin's work is seen both in the works copyrighted by Ottoman Hanafi scholars and in the works copyrighted by Hanafi scholars living in other geographies.
