Özet
Bu çalışmanın amacı, çocuk adalet sisteminde aktif çalışan meslek elemanlarının deneyimlerinden yola çıkarak sistemdeki eksikliklerin belirlenmesi ve bu eksikliklere yönelik çözüm önerilerinin ele alınmasıdır. Türkiye'de çocuk adalet sistemi içerisindeki çocuğun gelişimine yönelik geliştirilen sistemin bütüncül şekilde ele alınarak sistemler arası eksiklikten kaynaklı çocuğun yaşadığı ihmal durumunun incelenmesi amaçlanmıştır. Çalışmada, nitel araştırma yöntemi doğrultusunda kartopu görüşme tekniği ile sosyla hizmet uzmanı, psikolog, avukat ve polis olmak üzere 8 meslek elemanıyla derinlemesine görüşmeler gerçekleştirilmiştir ve verilerin analizinde betimsel analizi kullanılmıştır. Bu görüşmeler çerçevesinde araştırma için veriler toplanarak temalar oluşturulup bulgular elde edilmiştir. Araştırmamızın sonucuna göre; önleyici ve koruyucu hizmetlerdeki yetersizlikler sebebiyle çocuğun suça sürüklendiği veya mağdur edildiği sonucuna varılmıştır. Teorik olarak çocuk adalet sistemi çocuk hakları temelinde ele alınmış olsa da pratik süreçte çocuğun örselenmesine neden olan birçok dezavantajlı duruma rastlandığı ve bu sebeple ulaşılan bulgular aracılığıyla çocukların üstün yararının korunabilmesi adına sosyal hizmet müdahalelerinin arttırılması ve var olan müdahalelerin iyileştirilmesi önerilmektedir.

The aim of this study is to determine the deficiencies in the system based on the experiences of professional staff working actively in the juvenile justice system and to address the solution proposals for these deficiencies. It is aimed to examine the neglect situation experienced by the child caused by the lack of inter-system by Deconstructing the system developed for the development of the child within the juvenile justice system in Turkey in a holistic manner. In the study, in-depth interviews were conducted with 8 professional personnel, including social service specialist, psychologist, lawyer and police, using the snowball interview technique in accordance with the qualitative research method, and descriptive analysis was used in the analysis of the data. Within the framework of these interviews, data were collected for research, themes were created and findings were obtained. According to the results of our research, it has been concluded that the child has been dragged into crime or victimized due to inadequacies in preventive and protective services. Although theoretically the juvenile justice system has been addressed on the basis of children's rights, it is suggested to increase social service interventions and improve existing interventions in order to protect the superior benefit of children through the findings that there are many disadvantaged situations that cause the child to be harmed in the practical process.
