ÖZET Kayhan, Seyit Ahmet, İslâm Hukuk Metodolojisinde Lafiz-Mana İlişkisi (Delâlet Yollanl Yüksek Lisans Tezi, Danışman: Doç. Dr. Şamil Dağcı, 188s. Tez olarak ele aldığımız konuda, Kur' ân ve sünnetten hükümler çıkarılırken önde gelen İslâm hukuk usûlcü ve bilginlerinin lafiz ve ibarelerle bunlara yüklenen manaları nasıl irtibatlandırdıklannı ortaya koymaya çalıştık. Ele aldığımız konu etrafında İslâm hukuk usûlcü ve bilginleri arasında ortaya çıkan ilmî, fikrî ve felsefî görüşler ile metodolojik görüş ayrılıklarını ve farklılıklarını tespit etmeye çalıştık. Ayrıca konumuzla anlama ve yorumlama faaliyetleri açısından yakından ilgisi bulunan çağdaş anlambilim (semantik) ve yorumbilim (hermeneutik) gibi ilim dallarını da çalışmamıza dahil ettik. Çalışmamız iki bölümden ve sonuç kısmından oluşmaktadır. Birinci bölümde lafiz-mana ilişkisi ile ilgili kavramsal çerçeveye yer verdik. Bu başlık altında lafiz-mana ilişkisi etrafinda İslâm hukuk metodolojisi ile ilgili kavramları ele aldık. Mukayese yapılabilmesi için çağdaş anlambilim (semantik) ve yorumbilim (hermeneutik) ile ilgili kavramları tanımlamaya, taşıdıktan anlamlan tespit ve tahlil etmeye çalıştık. İkinci bölümde, İslâm Hukuk Metodolojisinde Lafiz-Mana İlişkisi adlı konuyu ele aldık. İslâm Hukuk Metodolojisinde Anlama Yöntemleri başlığı altında, hukukta kullanılan yorum metodlannı, usûl-i fikhın farklı ekollerine göre anlama yöntemini örneklerle ve karşılaştırmalı olarak ele aldık. Sonuç bölümünde ise değerlendirme, tespit ve önerilere yer verdik. 186

SUMMARY Kayhan, Seyit Ahmet, Relationship of Word-Meaning in Islamic Law Methodology (Way of Denotation), Master's Thesis, Advisor: Doç Dr. Şamil Dağcı, 188p. The subject of the thesis covers how the meanings attached to words and formulations by the leading Islamic law procedure definers and scientists while generating judgements based on Quran and ritual circumcisions are related to each other. In other words, efforts are made to see the relationship between the words and the meaning and understanding these relations. We have exerted efforts to determine the differences of views with respect to science, ideas and philosophic opinions and methodology that arose among the Islamic law procedure definers and the scientists and the differences on this subject which is forming the topic of the study. Furthermore, since such branches of science as contemporary semantic and hermeneutic are closely related to the topic of study from the angle of comprehension and interpretation activities, we have also included 5 such branches of science to this study. This study contains two sections and a section for conclusions. In the first section, we have concentrated on the relationship between words- meaning and formed a conceptual framework that is related to them. Under this heading, we have with priority, looked at the concepts that are related to the Islamic law methodology by staying around the word-meaning relationship. For comparison, 187we have tried to define the semantic and hermeneutic concepts and determine and analyze the meanings they have in them. In the second section, the subject titled relationship among Words-Meaning in contemporary the Islamic Law Methodology was studied. Under the heading Methods of Understanding in Islamic Law Methodology, the methods of interpretation used in law, methods of understanding according different schools of procedural canonical jurisprudence were presented with their samples and comparisons are made. In section for conclusions, assessments, determinations and proposals are presented. 188
