Özet

“Hukuk ve Tiyatro: Shakespeare Tragedyalarında Hukuk ve Adalet Gerilimi”adlı bu çalışma, disiplinler arası bir yaklaşımla tiyatronun hukuk düşüncesinin gelişimindeki rolünü incelemektedir. Hukukun teknik yönünün bazı uyuşmazlıkları çözmede yetersiz kaldığı durumlarda, yargıcın yaratıcı bir düşünce biçimine başvurması gerekebilir. İnsan trajedisini sonlandırmakla yükümlü olan yargının, yalnızca hukuki sorunlara çözüm üretmesi değil, aynı zamanda toplumsal birliği ve adalet duygusunu tesis etmesi de beklenir. Bu yönüyle yargının hem bireysel hem kamusal misyonu, dönemin ihtiyaçlarına uygun yeni araçların geliştirilmesini zorunlu kılar. Bu bağlamda tiyatro, hukuk ve adaletin yaratıcı bir biçimde yeniden düşünülmesine imkân tanıyan önemli bir alandır. Hukuk ve tiyatro arasındaki ilişki, çatışma ve sahneleme ortaklığı üzerinden kurulurken, tarihsel düzlemde özellikle tragedya formunda belirginleşir. Tragedya, tarihin önemli kavşaklarında çağa uygun şekilde yeniden dirilerek kolektif belleği güçlendirir. Öte yandan yaşamın içinden doğarak kendini var eden tragedya, pratik ve tarihsel koşullarla birlikte şekillenir ve çağının kimliğini inşa eder. Bu bağlamda kimlik arayışında olan 16. yüzyıl İngiltere'si, Hamlet tragedyasıyla kimlik sorununa odaklanır. Hamlet tragedyası, iktidar-özne ilişkisine referansla kamu hukukunun temel ilkelerini tartışırken, Venedik Taciri oyunu İngiliz hukuk geleneğine özgü common law- equity law gerilimini dramatik temsile dönüştürerek yargıç pratiği üzerine yoğunlaşır.

This study titled“Law and Theatre: The Tension Between Law and Justice in Shakespearean Tragedies”examines the role of theatre in the development of legal thought through an interdisciplinary approach. In situations where the technical aspects of law prove insufficient to resolve certain disputes, the judge may need to resort to a creative mode of thinking. The judiciary, which is responsible for bringing human tragedy to an end, is expected not only to produce solutions to legal problems but also to establish social unity and a sense of justice. In this respect, the judiciary's mission, both individual and public, necessitates the development of new instruments appropriate to the needs of the period. In this context, theatre constitutes an important field that enables law and justice to be reconsidered in a creative manner. While the relationship between law and theatre is established through a shared structure of conflict and staging, it becomes particularly evident in the form of tragedy on a historical plane. Tragedy strengthens collective memory by being revived in accordance with the spirit of the age at critical junctures of history. On the other hand, tragedy, which emerges from life itself and constitutes its own existence, is shaped together with practical and historical conditions and constructs the identity of its age. In this context, sixteenth-century England, which was in search of identity, focuses on the problem of identity through the tragedy of Hamlet. While the tragedy of Hamlet discusses the fundamental principles of public law with reference to the relationship between power and the subject, the play The Merchant of Venice focuses on judicial practice by transforming the tension between common law and equity law—specific to the English legal tradition—into dramatic representation.
