Özet
İslam dininde, dinde zorlama yoktur ayeti gereğince gayrimüslimler Müslüman olmaya zorlanmamıştır. Bilakis din ve inanç özgürlükleri korunmuştur. Bu sebeple İslam medeniyetinin en başından itibaren gayrimüslimler İslam hukuku gereğince zimmi statüsünde Müslümanlarla beraber aynı toplumda yaşamışlardır. Çalışmamızın konusunu oluşturan kısım ise inanç hürriyetlerine sahip olan zimmilerin kiliseleridir. Konuda ilk olarak Osmanlı Devleti'ndeki gayrimüslimlerin durumu incelenmeye çalışılmıştır. Devletin kuruluşundan itibaren on altıncı yüzyıla kadar olan süreç için tarihi kaynaklardan yola çıkılarak gayrimüslimlerin toplumsal ve idari yapılandırılması ve kiliselerinin durumu incelenmeye çalışılmıştır. Sonrasında kiliselerin İslam hukukunda nasıl değerlendirildiğini görmek adına mesele Hanefi mezhebi özelinde ele alınmıştır. Kiliselerin statüsü bulundukları yerlerin nasıl fethedildiği ve şehir ya da köy oluşuyla ilgili olduğu için konu bu şekilde takip edilmiştir. Son olarak ise kiliselerin Osmanlı uygulamasında nasıl bir statüye sahip olduğu dönemin şeyhülislam fetvalarından ve kadılara gönderilen hükümler üzerinden takip edilmeye çalışılmıştır. Kilise fıkhı derken kastedilen ise fethedilen yerlerdeki kiliselerin durumu, ibkâ edilen kiliselerin ihtiyaç halinde tamiri ve yeni kilise ihdâs edilip edilemeyeceği gibi konulardır.

In Islam, non-Muslims were not forced to convert to Islam by the verse“There is no compulsion in religion.”On the contrary, freedom of religion and belief has been protected. For this reason, from the very beginning of Islamic civilization, non- Muslims lived in the same society as Muslims as dhimmīs by Islamic law. The subject of our study is the churches of the dhimmīs who have freedom of belief. The subject was first examined in the Hanafi madhhab to see how churches are evaluated in Islamic law. The issue has been followed in that way since the status of churches is related to how they were conquered and whether they became cities or villages. After examining the status of the church in fiqh doctrine, the status of non-Muslims in the Ottoman Empire was analyzed. An attempt was made to examine the social and administrative structure of non-Muslims and the situation of their churches, based on historical sources, for the period from the foundation of the state to the sixteenth century. Finally, the status of churches in Ottoman practice is traced through the fatwas of the Shaykh al-Islāms of the period and the rulings sent to the qāḍīs. What is meant by church jurisprudence is the status of churches in conquered areas, the repair of churches that continue to function (ibkâ) in case of need, and whether new churches can be established.
