Özet
Çalışmamız kapsamında, profesyonel futbolcu sözleşmelerinin feshi neticesinde taraflar arasında doğan tazminat borcunun kapsamı incelenmiştir. Futbolun ulaştığı devasa ekonomik boyut, sözleşmenin feshi halinde doğan tazminat borcunun kapsamını son derece önemli kılmaktadır. Sözleşmenin feshi nedeniyle doğan tazminat borcunun kapsamı belirlenirken; öncelikle feshin haklı bir sebebe dayanıp dayanmadığı tespit edilmeli, ardından tazminat borçlusunun kim olduğu tayin edilmelidir. Bu doğrultuda çalışmamız dört ana bölüme ayrılmıştır. Birinci bölümde, profesyonel futbolcu sözleşmesinin hukuki niteliği ve fesih nedeniyle tazminat borcunun doğumu için gereken şartlar incelenmiştir. İkinci bölümde kulübün, üçüncü bölümde ise futbolcunun tazminat borcunun kapsamı analiz edilmiştir. Dördüncü bölümde ise sözleşmenin feshinin sonuçlarına ilişkin yapılan anlaşmaların tazminat borcuna etkisi incelenmiştir. Çalışmamızın amacı; öğretideki görüşler ve uygulama örnekleri ışığında, profesyonel futbolcu sözleşmesinin feshi dolayısıyla doğan tazminat borcunun kapsamının doğru şekilde belirlenmesini sağlayacak hukuki bir perspektif sunmaktır.

This study examines the scope of the compensation obligation arising between parties as a result of the termination of professional football player contracts. The massive economic scale of modern football renders the scope of compensation arising from contract termination extremely significant. When determining the scope of this compensation obligation, it must first be established whether the termination is based on just cause, followed by identifying the liable party. Accordingly, this study is structured into four main chapters. The first chapter examines the legal nature of professional football player contracts and the necessary conditions for the compensation obligation to arise upon termination. The second chapter analyzes the scope of the club's compensation obligation, while the third chapter focuses on the scope of the player's compensation obligation. The fourth chapter investigates the impact of agreements made regarding the consequences of termination on compensation obligation. In light of doctrinal views and practical precedents, the objective of this study is to provide a legal perspective that ensures the accurate determination of the scope of compensation arising from the termination of professional football player contracts.
