Özet

Ağaç Kesme Suçunun Orman Kanunu Açısından İncelenmesi Orman varlığı, artan nüfus ve endüstrileşme baskısı nedeniyle, gün geçtikçe nitelik ve nicelik olarak azalmakta ve mevcut ormanların muhafazası acil koruma tedbirlerinin alınmasını gerektirmektedir. Ormanların gördüğü baskıdan en fazla etkilenen unsur orman ağaçlan olmuştur. Ağaçların özellikle“mal”olarak görülmesi ve ekonomik değerinin cazibesi ağaç kesme suçunun orman suçlan arasında en fazla işlenmesine neden olmaktadır. Ülke koşullan ve mevcut yasalar ağaç kesme suçunu cazip hale getirmiş, yürürlükte olan 6831 sayılı Orman Kanunu'nun çelişkili hükümleri ve ceza yaptırımının yetersiz olması gibi nedenlerle suçun önlenmesinde istenilen başarıya ulaşılamamıştır. Bu hususla birlikte orman koruma sisteminin yetersiz kalışı da ağaç kesme suçunun artışına neden olmaktadır. Çalışmada ağaç kesme suçu ceza genel hukuku çerçevesinde incelenmiş, Orman Kanunu'nda yer alan boşluklar ortaya konmaya çalışılmış, bu boşluklar doldurulurken uygulamaya yardımcı olunması hedeflenmiştir.

The Investigation of Tree Felling In Terms of Forest Law Over the years, forestlands have been decreasing due to the development and population pressure. Because of that pressure, it is essential to protect those forests from development, over exploitation, and destruction. The activities that violate forest statute are called“forest crimes”. Those crimes were enacted particularly to prohibit the activities that destruct forests. In this study, I discuss the pros and cons of tree cutting in terms of the general theory of criminal law, Then, I criticize those of crime and make recommendations to policy makers' deal with Ibis issue. The origin of illegal tree cutting can be derived from the initial restrictions that came in the use in the Ottoman Empire era. About 15 century, first restrictions on forests took place without any punishment. Then, around 16. and 17. Century, the first punishment such as fine was put into execution. Currently, it is still the case that the most expanded forest crime is tree felling. As an average, about 135.000 cubic meters of wood per year has been cut down illegally. The most prominent underlying causes of those activities are; Jğ?± economical reasons unsatisfactory punishment, *î**a& lack of authoritative control, and personnel and equipment deficiencies. To sum, tree-cutting poses a serious problem that destroys a substantial amount of forestlands for several years. To prevent the forests from such an illegal practice, a series of solutions should be put into practice and the forestry code of 6831 is to be amended in terms of increasing punishment and take necessary steps to do strict authoritative control.
