Özet
Yöneticilerin seçimle iş başına gelmesi ve seçimlerin sağlıklı bir şekilde denetlenmesi demokratik devletin olmazsa olmaz unsurlarından biridir. Denetlemenin demokrasiye uygun olması ise, seçimleri denetleyecek ve seçim işlerini yürütecek organların bağımsız, şeffaf, güvenilir ve yargısal nitelikte olması ile ilgilidir.Seçim sadece oy verme anından ibaret değil, uzun bir süreçtir. Seçim sürecinin başından sonuna kadar seçim işlerini yürütmeye yönelik işlemlerle, seçimleri sonuçlandırmaya yönelik işlemlerin etkin bir şekilde denetlenmesinin demokratik meşruiyet açısından önemi tezimizde değerlendirilmiştir.Yapmış olduğumuz bu tez çalışması, iki bölümden oluşmaktadır.Birinci Bölümde; seçim kavramı üzerinde genel olarak durulduktan sonra, Türkiye'nin seçim tarihi değerlendirilmiş ve seçim hukukunda yer alan ilkeler ele alınmıştır. Daha sonra da seçim işlerinin yürütülmesi konusu incelenmiştir. Seçim işlerinin yürütülmesi konusunda, hazırlık işlemleri, oy verme ve sonuçların ilanı, seçimlerin adaletli olmasını sağlamaya yönelik önlemler, seçim sonuçlarının tespit ve ilanı gibi konulara yer verilmiştir. Seçimin sadece oy verilen an olmadığı uzun bir süreç olduğu, bu kapsamda seçim sürecinin her aşamasında ve özelde seçim işlerinin yürütülmesi aşamasında da ilgili görevli kurullarca denetlenmesi gerekeceği gözetilerek, bu aşamadaki yapılan denetimlere de yer verilmiştir. Zira seçim işlerinin yürütülmesi aşaması da seçimin bir süreç olduğu dikkate alındığında, bu sürecin her evresinin dürüst, güvenilir ve adil bir şekilde denetlenmesini gerekli kılması yönünden büyük öneme sahiptir.İkinci Bölümde; seçimlerin denetlenmesi konusu incelenmiş, dünyada ve Türkiye'de kullanılan seçim denetleme yöntemleri değerlendirilmiştir. Bu kapsamda öncelikli olarak, Türkiye'de seçim işlerinin yürütülmesi ve seçimlerin denetlenmesi görevlerini yerine getiren, tüm seçim sürecinin denetleme organı olan seçim kurulları incelenmiştir. Ayrıca bu bölümde, seçimlerin denetlenmesinde seçim yasalarının öngördüğü kanun yolları olan şikayet ve itiraz kurumları her yönüyle ele alınmış, Yüksek Seçim Kurulu'nun seçimlerin denetlenmesinde geliştirdiği olağanüstü bir itiraz yolu olan ?Tam Kanunsuzluk? içtihadı açıklanmıştır. Son olarak da seçimlerin, seçme ve seçilme yeterliliği yönünden özel olarak değerlendirilmesi yapılmıştır.

Delegation of the administrators through elections and sound auditing of the elections are among sine qua non elements of a democratic state. Democratic compliance of the audit is related with the independent, transparent, reliable and juridical character of the bodies to conduct and audit the elections.Election is a long process which does not merely consist of casting vote. In our thesis, the significance of effectively auditing the operations concerning the conduct of the whole election process and concluding the elections is assessed in terms of democratic legitimacy.This thesis comprises of two sections.In the first section, after explaining the election concept, the electoral history of Turkey has been assessed and the principles of election law have been scrutinised. Afterwards, conduct of electoral operations is examined. Concerning the conduct of electoral affairs, issues such as preparations, casting the votes and announcement of results, measures taken for a just election, ascertainment and announcement of election results are examined. Taking into account the fact that election is a long process which does not merely consist of casting the votes and the fact that this process must be audited by competent boards at all stages and especially at the stage of conducting the electoral affairs in this context, the audits at this stage are also examined. Because, taking into account that conducting the electoral affairs is also a process, it is of great importance to audit every stage of this process in an honest, reliable and just manner.In the second section, the issue of auditing the elections is examined, the methods used for auditing the elections in Turkey and in the world. In this context, elections boards which are responsible for auditing the conduct of electoral affairs and auditing of elections as the auditing organ for the whole election process are primarily examined. Also in this section, complaint and appeal terms are examined from all aspects as remedies foreseen by the election laws for the auditing of elections, the case-law of the Supreme Elections Board named ?Sheer Unlawfulness? as an exceptional remedy in the audit of elections is expressed. Finally, an evaluation of elections is made from the aspect of competence to cast vote and eligibility.
