Özet

Ekoturizm genel anlamda turizm faaliyetinin bir alt türü olup doğal hayatla ve doğal kaynaklarla uyumlu sürdürülebilir bir turizm faaliyetini ifade etmektedir. Ekoturizm gerek uluslararası düzeyde ve gerekse ulusal düzeyde yeni ortaya çıkmış bir faaliyettir. Politika, yönetim ve hukuk metinlerine girişi de aynı şekilde son derece yenidir. Uluslararası düzeyde ekoturizm en geniş katılımı ve yaygın etkisi ile ilk kez, 2002 tarihli Quebec Ekoturizm Zirvesi ile dünya gündemine gelmiş ve alınan kararlar bir Ekoturizm Deklarasyonu ile ilan edilmiştir. Gerek ekoturizm yönetimi ve gerekse ekoturizm hukuku bakımından temel ve önemli hükümlerin yer aldığı söz konusu zirve Deklarasyonu, bir anlamda ekoturizmin temeli ve hatta anayasası olarak nitelendirilebilecek niteliktedir. Ulusal düzeyde ise ekoturizm ilk kez, 9. Beş yıllık kalkınma planında yer almıştır. Ancak, ekoturizmin genel anlamda turizm faaliyetinin bir alt türü olması nedeniyle, niteliğine uyduğu ölçüde, daha önceki kalkınma planlarında da kendine yer bulduğunu belirtmek gerekir. Benzer şekilde hukuksal temeli bakımından da ekoturizm kavramı ilk olarak 2634 sayılı Turizmi Teşvik Kanununun 8. maddesinde yer almış ise de, niteliğine uygun olduğu ölçüde, ilgili sair mevzuatta daha önceden beri yer bulmuştur. Fakat birçok niteliği bakımından mevcut mevzuat ve yönetsel metinler günümüz ihtiyacını karşılamaktan son derece uzaktır. Ülkemizde orman arazileri üzerinde ekoturizm faaliyetinin idari ve hukuksal temelleri ise henüz tam anlamıyla açıklığa kavuşturulmamıştır. Çalışmada bu sahaya ışık tutması amaçlanmaktadır. Bu kapsamda, çalışmanın temel amacı, ekoturizm kavramının idari ve hukuksal temellerini ortaya koymak, hükmü bulunmayan konularda öneriler geliştirmek ve alternatif bir ekoturizm yapısı ortaya koyarak mevcut mevzuatın güncellenmesi amacıyla önerilerde bulunmaktır. Çalışmanın ilk kısmında genel anlamda turizm hukuku ve yönetimi ve bunların gelişimine yer verilmiş; ikinci kısmında ekoturizm kavramı ve kavramın hukuksal ve yönetsel olarak gelişimine yer verilmiştir. Çalışmanın devamında ekoturizm hukukunun temelleri açıklanmış ve son bölümde ise orman arazileri üzerinde ekoturizm faaliyetinin yönetsel ve hukuksal temellerine değinilmiştir. Çalışma, sonuç ve öneriler kısmı ile sonlandırılmıştır.

Ecotourism in general is a subbranche of tourism concept and has a meaning of a tourism activity in harmony with natural life and natural resources in a sustainable manner. Ecotourism, at both international and national level, has been assigned as a newly emerged tourism activities. It has just recently been entered into political, administrative and legal documents. At international level, ecotourism came to public agenda for the first time with the Quebec Ecotourism Summit held in 2002 Canada attracting widely participants form all over the World and the decision made by the delegations of the Summit have been declared as Quebec Ecoturism Declaration. That Declaration, having significant legal provisions about both ecotourism management and ecotourism laws, is to be considered as a fundamental document and its constitutions in a sense. At national level ecotourism was put into 9th.-Fifth years country development plan for the first time. On the other hand, since ecotourism is considered as a subcategory of the tourism activities in general, provisions placed into former country development plans have been considered as including ecotourism activities as long as it is appropriate for it. Similar to that, legal basis of ecotourism activities can be traced back to the article 8 of the Law on Tourism Encouragement, No: 2634 and relevant other laws are also applicable for ecotourism as long as it is appropriate for its characteristics. But, actual legal provisions and administrative documents are far from meeting the expectation of present day ecotourism activities. On the other hand, legal and administrative basis of ecotourism activities have not yet been investigated satisfactorily in Turkey. This study is significantly important in this respect as well. In light of the above summary information the purpose of this study is to investigate legal and administrative basis of ecotourism activities, to make recommendations about the issues not provisioned in current legislation, to develop alternative administrative structure for ecotourism and to update present legislation. In the first part of the study tourism laws and administration and their developments have been investigated; in the second part the concept of ecotourism and its legal and administrative development have been studied; following that legal basis of ecotourism activities have been explained and in the last section the possibilities of ecotourism investment in forestlands and its legal and administrative basis have been discussed. Then the study has ended conclusion and recommendations about ecotourism administration and its legal basis.
