In international dispute resolution system, multi-tier dispute resolution agreements have been increasingly preferred for more effective and less costly dispute resolution also with the legislative encouragement. However, in practice of multi-tier dispute resolution, non-fulfilment of initial alternative dispute resolution procedures before formal stages raises certain issues. These issues are related to determination of applicable law to validity of alternative dispute resolution clauses in multi-tier dispute resolution agreements and validity and enforceability of these clauses. In general, the countries decide their own laws being applicable to validity of these clauses pursuant to their conflict of law rules during the dispute resolution process. Furthermore, the countries determine the required conditions for a valid and enforceable multi-tier dispute resolution clause differently. Ultimately, these issues impact enforceability of eventual arbitral award. To eliminate such an impact, the solutions are careful drafting by parties, harmonisation on conflict of law rule to determine the applicable law to validity of these clauses and, further, harmonisation of substantive law applicable to alternative dispute resolution procedures. UNCITRAL Model Law on International Commercial Conciliation 2002 is a good starting point for harmonisation of substantive law.
