This paper examines the developments of Bosnia and Herzegovina in terms of estabHshing functional democratic institutions and sustainable peace building. By taking into account the historical circumstances of Bosnia and Herzegovina as a former part of Yugoslavia, special attention is drawn on the ethnical element of the Bosnia-war. Two theories act as theoretical background in order to support the drawn conclusions. The realistic theory was used to better understand what led Yugoslavia in a process of disintegration and later to a devastating war, while the theory of Institutionalism was very helpful in order to assess which institutions and capacities are crucial for a new independent state. The thesis is based on empirical analysis, like shown in the list of references. As primary sources we worked with sources like the Dayton-Treaty and the constitution of Bosnia and Herzegovina and the Republika Srpska, which are based on this treaty. Other sources of research were official papers of relevant International Organizations and conclusions of involved experts. With the above mentioned theories the paper examines why the democratic process is facing so many difficulties in Bosnia and Herzegovina and the influence of the Dayton-Treaty in this regard. The role of the international community and especially the role of the Office of the High Representative for Bosnia and Herzegovina is another important focus of analysis. The conclusion of this paper is that the international community, especially the UNO, has lost credibility in the region because of its late intervention in the war. The missing consensus among the international community on the necessary actions to be taken was another reason why the hopes of the Bosnian people ended up being squashed. Ultimately the missing willingness to compromise among the Bosnian parties and involved ethnicities is identified as an obstacle for forthcoming democratic cooperation in Bosnia and Herzegovina.
