In the information age, society is shaped by information technologies. These technologies affect our daily lives. Software is one these technologies. Almost every machine in our daily lives, including computers and mobile phones, runs with software. Such a vital tool naturally has an economic value; therefore it needs protection. The important point is whether public interest has been taken into account when protection policies were composed. After debates over decades, copyright law was found applicable for software protection; however, patent protection comes along with it unofficially. Patent protection creates inefficiency for public welfare due its nature that provides extensive and exclusive rights. On the other hand, copyright law provides fair legislation; however, it is not fully effective due to some of its applications. Licence agreements can sometimes bypass copyright and provide overprotection for companies. In addition, there is a monopoly threat in the software industry, which inevitably affects the market and the public. Nevertheless, there are some favourable methods like reverse engineering and open source software that can revive the industry if their applications would be smoother. In addition, these methods can contribute to creative collaboration which maximises the commonweal. However, there are also some user-based problems that harm development and innovation. Piracy is one of them; it creates a lose-lose situation in the long term for both parties. Additionally, online methods like illegal file sharing and cloud technology usage compel software companies to fix these bugs and detain them from investing in new technologies. Considering the public benefit in protection policies will increase the effectiveness and thus innovation. On the other hand, intellectual property law should follow technological improvements faster and respond to changes in order to facilitate software developers' efforts.
