Özet

Vekilin, vekalet verene ait bir işi, zaman kaydına bağlı olmaksızın ve sonucun elde edilememesi riski vekalet verene ait olmak üzere üstlendiği sözleşmeye vekalet sözleşmesi denilmektedir. Günümüzde meydana gelen ekonomik gelişmeler vekalet sözleşmesinin uygulama alanını oldukça genişletmiştir. İşbu husus da vekalet sözleşmesinin sona erme nedenlerinin detaylı olarak incelenmesi gerekliliğini beraberinde getirmiştir. Vekalet sözleşmesinin sona erme nedenleri Türk Borçlar Kanununun 512. ve 513 maddelerinde düzenlenmiş olup bunlar; tek taraflı sona erdirme, ölüm, ehliyetin kaybedilmesi ve iflastır. Bu çalışmamızda vekalet sözleşmesinin sona erme nedenleri ve sona ermenin hüküm ve sonuçlarının ayrıntılı olarak incelenmesi amaçlanmaktadır. Contract of Mandate is an agreement in which the proxy giver carry the risk of not obtaining the result, whereas the proxy undertakes to render a work belonging to the proxy giver without being bound to the time limit. Economic developments happening today have greatly expanded the application area of the contract of the mandate. This has brought about the necessity of a detailed examination of the reasons for the dissolution of the contract of the mandate. Dissolution reasons of the contract of the mandate are set forth in articles 512 and 513 of the Turkish Code of Obligations. These are a unilateral dissolution, death, loss of capacity and bankruptcy. In this study, it is aimed to examine in detail the reasons for the dissolution of the contract of mandate and the provisions and consequences of the dissolution.
