Özet
İslam fıkhında; seyahatte ibadet hükümleri dışında kalan yolcu hak mükellefiyetlerini konu edinen bu araştırmamız; giriş, birinci bölüm, ikinci bölüm ve sonuç olmak üzere dört ana bölümden meydana gelmektedir. Giriş bölümünde araştırmanın konusu, amacı, yöntemi ve kavramsal çerçevesi ile temel kaynakları açıklanmıştır. Birinci bölümünde seyahat kavramı, mahiyeti, çeşitleri ve ilişkili olduğu diğer kavramlar ortaya konulmuştur. Bu bölümde Kur'an ve sünnette sefer şekilleri, sefer ve yolculukların hedefleri anlatılmıştır. İkinci bölümde sefer ve yolcu kavramı, sefer çeşitleri, bireylerin hukuki statülerine göre sefer hükümleri anlatılmıştır. Bu Bölümde seyahat akdinin niteliği, kayıt altına alınması, seyahat belgesi (bilet) ele alınmış hukuki hususiyeti, muhteviyatı, ortaya konulmaya çalışılmıştır. İkinci bölümün yolcunun hak ve mükellefiyetleri ana başlığı altındaki diğer başlığı seyahat akdinde muhayyerlik konusunun anlatıldığı bölümdür. Bu bölümde yolcunun muhayyerlik hakları başlığı altında; meclis muhayyerliği, görme, şart, tayin ve ayıp muhayyerlikleri tarif edilmiş, seyahat akdindeki hükümlerin hem yolcu hem seyahat şirketi açısından sonuçları ortaya konulmaya çalışılmıştır. Tezimizin ana konusu olan seyahat akdi yolcu ve şirketinin hakları ve mükellefiyetlerinin ele alındığı bölüm ise sonuç kısmından önce ele alınmıştır. Bu bölümde hakların çıkış kaynakları ve seyahat akdinin çıkış kaynağı açıklanmış mükellefiyet hak ilişkisi belirtilip seyahat akdi taraflarının hakları ve mükellefiyetleri maddeler halinde açıklanmıştır. Tezimiz sonuç kısmıyla bitirilmiştir.

In Islamic jurisprudence; this research, which deals with the rights of passengers other than the provisions of worship in travel; The entrance consists of four main sections: the introduction section, the first section, the second section and the result. In the introduction part, the subject, aim, method and conceptual framework of the research and its main sources are explained. In the first part, the concept of travel, its nature, its types and other related concepts are presented. In this section, the forms of traveling, voyages and journeys in the Qur'ân and tradition of the Prophet Muhammed (pbuh) are described. In the second part, the concept of voyage and passenger, types of voyage, the provisions of voyage according to the legal status of individuals are explained. In this Chapter, the nature of the travel contract, the registration, the travel document (ticket) is discussed, the contents of the legal feature is tried to put forward. The second part of the second section under the title of the rights and obligations of the passenger is the section on the subject of imagination in the travel contract. In this section, under the title of immigration rights of the passenger; parliamentary imagination, vision, condition, designation and shame of imagination have been described and the provisions of the travel contract have been tried to be put forward in terms of both passenger and travel company. The main subject of our thesis, which covers the rights and obligations of the travel contractual passenger and company, is discussed before the conclusion. In this Section, the sources of the rights and the origin of the travel contract are explained and the rights and obligations of the parties to the contract are explained in lists. The thesis is concluded with the conclusion part.
