Özet
Yüksek lisans tezi kapsamında yenilenebilir enerjiler kamu hukuku içerisinde incelenmektedir. Bu doğrultuda konunun sadece temel teknik ve hukuki bileşenlerinde sunulup incelenmediği aynı zamanda ilgili konulara ve sorunlara da atıfta bulunulmuştur. Bu not ile yenilenebilir enerjiler kamu hukuku içerisinde sunulmakta ve tartışılmakta olup enerji verimliliği veya tüm enerji dönüşümüne sürekli olarak atıfta bulunulmaktadır. Mevcut enerji politikasının ve enerji yönetiminin neden olduğu ekolojik ve ekonomik sorunlar artık görmezden gelinmeyecek bir noktaya gelmiştir. Küresel ısınma, hayvan türlerinin neslinin tükenmesi, küresel ve bölgesel ölçekte askeri ve ekonomik çatışmalar gibi sorunlar veya mevcut enerji kaynaklarının ekonomik uygulanabilirliği ve arz güvenliğiyle ilgili endişeler, enerji dönüşümü olarak bilinen bir süreci başlattı. Enerji dönüşüm süreci, sürdürülebilir ve temiz bir enerji tedarik sistemi oluşturma sürecini tanımlar. Bu dönüşüm sürecindeki kilit rol, başarılı ve zamanında yapılacak olan yenilenebilir enerjilere geçiştir. Bu da bize yenilenebilir enerjiler konusunun diğer birçok konuyla ilgili olduğunu gösteriyor. İş bu tezin yapısı yukarıda belirtilen hususlar dikkate alınarak planlanmış ve tasarlanmıştır. Tezin ilk bölümünde yenilenebilir enerjiler konusu genel olarak ele alınmıştır. Bu kapsamda bir yandan konuyla ilgili genel tanım ve karşılaştırmalar sıralanırken, diğer yandan kavramsal ve yasal gelişmeler ile yenilenebilir enerjiler konusu etrafında dönen güncel olaylar ve tartışmalar sıralanmaktadır. Tezin ikinci bölümünde konunun hukuki kısmı detaylı olarak sunulmuştur. Yenilenebilir enerji hukuk ve ilgili hukuk alanları çoğunlukla kamusal niteliktedir. Tezin başlığının“Kamu Hukuku Perspektifinden Yenilenebilir Enerjiler”olduğu düşünülecek olunursa, bölüm 2'nin bu çalışmanın kalbi olduğu söylenebilmektedir. İkinci bölüm dahilinde yenilenebilir enerjiler konusu kamu hukukunun en önemli hukuk disiplinleri kapsamında sunulmakta, konumlandırılmakta ve tartışılmaktadır. Ayrıca konu hukuk uygulamasında içtihatlar temelinde sunulmaktadır. Tezin 3. Bölümü, enerji dönüşüm sürecinin genel terimi içinde ilgili bir konuyu incelemektedir. Enerji tasarrufu ve bunun sonucunda ortaya çıkan enerji verimliliği konuları, yenilenebilir enerjiler konusu ile bağlantılı olarak terminolojik ve hukuki açıdan tezin üçüncü bölümü kapsamında incelenmiştir. Tezin 4. Bölümü, konunun teknik, bilimsel ve hukuki açıdan öngörüleri sunmaktadır. İçerik ve öngörüler ile bağlantılı olarak, sonuç kısmı tüm konuyu tamamlamaktadır.

The following master thesis is about renewable energies within the public law. It is important to note that the issue of renewable energies is not only presented and discussed in its elementary and important elements in a purely technical and legal way, but also references are made to related topics and problems. Under this reserve, the issue of renewable energies within public law is presented and discussed but also references to issues such as energy efficiency or the complete transformation of energy systems are made and its connections are presented. Ecological and economic problems caused by the current energy policy and economy have reached a point where they are no longer manageable and ignorable. Problems such as global warming, the extinction of animal species, military and economic conflicts of global and regional proportions or concerns about the economic viability and security of supply of current energy sources have initiated a process known as energy transition. The energy transition is the process of establishing a sustainable and clean energy supply system. The key role within this transition is the successful and timely transition to renewable energy. In summary, this means that the issue of renewable energy is related to many problems and issues. The following master thesis tries to present and describe the topic of renewable energies from a public law perspective in connection with those problem areas and topics. Under this reservation, the thesis was designed and structured accordingly. Part one of the work is dealing with the facts of the issue of renewable energies. In this part, general definitions and comparisons concerning the topic as well as the conceptual and legal development and the current events and discussions concerning the topic of renewable energies are presented. The second part of the work is dealing with the legal part of the topic in detail. The law of renewable energies and the areas of law connected with it are mostly of a public law nature. Considering, that the title of the work is named“renewable energy from a public law perspective”it can be said, that part two is the core part of the work. In the second part, the issue of renewable energy is presented, positioned and discussed within the main legal disciplines of public law. In addition, the topic is dealing with the application of law by means of jurisprudence. The third part of the work is dealing with a related topic regarding the generic terms of energy system transformation but due to its function within the topic of renewable energies it is directly related to the main headline. In the third part, the topic of energy saving and in connection with it the topic of energy efficiency is presented from a terminological and legal point of view, related to the topic of renewable energies. The last part, i.e. part four of the work, is dealing with the forecasts from a technical, scientific and legal point of view and the conclusion, regarding the topic of renewable energies related to their role within the energy system transformation.
