Özet
Bu çalışmanın konusu 5237 sayılı Türk Ceza Kanununda düzenlenen Tefecilik Suçudur. Hukukumuzda tefecilik kavramı ilk olarak 2279 sayılı Ödünç Para Verme İşleri Kanununda tanımlanmıştır. Daha sonra 90 sayılı Ödünç Para Verme İşleri Hakkında Kanun Hükmünde Kararnamede düzenlenmiş ve nihayet 5237 sayılı Türk Ceza Kanunu'nun 241inci maddesinde açıkça suç olarak düzenlenmiştir. Çalışmamızın esasını 5237 sayılı Türk Ceza Kanunu'nun Özel Hükümler adlı İkinci Kitabının Topluma Karşı Suçlar adlı Üçüncü Kısmının Ekonomi, Sanayi ve Ticarete İlişkin Suçları düzenleyen Dokuzuncu Bölümünün241inci maddede düzenlenen tefecilik suçu oluşturmaktadır. Suç genel teorisi kapsamında yapılacak incelemede 2279 sayılı Kanun ve 90 sayılı KHK kapsamında suçun nasıl düzenlendiği hususuna da değinilmiştir. Tefecilik suçu incelenirken birçok kavramla karşılaşılmaktadır. Bu nedenle çalışmanın başında kavramların tanımı yapılarak konunun daha anlaşılır olmasını sağlamaya çalıştık. Bu kavramlar arasında tefecilik suçunun temelini oluşturan faiz kavramı tanımının yanı sıra tarihsel süreç de kısa bir şekilde anlatılmıştır. Çalışmada suçun tanımı, maddi ve manevi unsuru, özel görünüş şekilleri konusunda tartışmalı noktalar doktrinde yer alan görüşler ve Yargıtay kararları göz önünde alınarak, kendi kanaatimiz ile anlatılmaya çalışılmıştır.

The subject of this study is the crime of usury regulated within the scope of the Turkish Penal Code numbered 5237. In our law, the concept of usury was first defined in the Law No. 2279 on Money Lending Law. Then, it was regulated in the Decree Law No. 90 on Lending Transactions and finally rearranged in article 241 of the Turkish Penal Code No. 5237.The essence of our study is the crime of usury, regulated in Article 241 of the Ninth Section of the part which regulates the Crimes Regarding Economy, Industry and Trade of the Third Part called Crimes Against Society of the Second Book called Special Provisions of the Turkish Penal Code numbered 5237.In the examination to be carried out within the scope of the general theory of crime, the issue of how the crime is regulated within the scope of Law No. 2279 and Decree No. 90 is also mentioned. Many concepts are encountered when examining the usury crime. For this reason, we tried to make the topic more understandable by defining the concepts at the beginning of the study. Among these concepts, besides the definition of interest, which forms the basis of usury, the historical process of interest is also briefly explained. In the study, the definition of the crime, the material and spiritual element of the crime, the controversial points about the special appearance of the crimewere tried to be explained according to the opinions contained in the doctrine, the Supreme Court decisions and our opinions.
