Özet
6769 sayılı Sınai Mülkiyet Kanunu'nda da açıkça düzenlendiği üzere Türk hukukunda marka hakkı tescil yoluyla elde edilmekle birlikte istisnai olarak marka hakkının kullanım yoluyla kazanılması da mümkündür. Marka hakkının elde edilmesine ilişkin iki farklı yol olması, uygulamada eskiye dayalı olarak ticaret unvanı, işletme adı, alan adı gibi tanıtma vasıtalarını ya da tescilsiz işaretleri kullanan kişilerle sonradan bu işaretleri marka olarak tescil ettiren kişiler arasında hak sahipliğine ilişkin ihtilaf meydana getirmektedir. Bu ihtilafların çözümüne ilişkin marka siciline tescil ile korunan marka sahibinin mi yoksa hakkaniyet gereği eskiye dayalı kullanım sebebiyle işaret üzerinde gerçek hak sahibi olan kişilerin mi korunması gerektiği doktrinde ve Yargıtay içtihatlarında pek çok açıdan tartışılmıştır. Çalışmanın konusu itibariyle öncelikle SMK md.6/3 kapsamında tescilsiz markalar ve SMK md.6/6 kapsamında başkasına ait ad ve işaretler arasındaki ilişki değerlendirilmiş ve bu çerçevede ticari alanda kullanılan ad ve işaretlerden olan; ticaret unvanı, işletme adı, alan adı, coğrafi işaret, tasarım ve tescilsiz marka hakkında genel bilgiler verilmiştir. Akabinde bu ad ve işaretlerin uygulamada hangi hallerde marka tescil engeli ve hükümsüzlük sebebi olduğu doktrinsel tartışmalar ve örnek içtihatlarla da somutlaştırılarak ayrıntılı şekilde incelenmiş, tescil başvurusu yapılan markanın tescilinin engellenmesi ve tescil edilen markanın hükümsüz kılınması için uygulanacak prosedürler ele alınmıştır.

As regulated explicitly in the Industrial Property Law (IPL) No. 6769, the trademark right can be obtained through registration in Turkish law whereas it has been possible to obtain via right of usage in exceptional cases. Having two different fashion of obtaining the trademark right, in practice, creates controversy regarding the ownership of rights between the people who use the means of promotion or unregistered signs such as trade name, company name, domain name based on the past and those who subsequently register these marks as trademarks. Regarding the settlement of these controversies, it has been discussed in many aspects in the doctrine and the jurisprudence of the Court of Appeals whether the trademark proprietor is protected by registration in the trademark registry or the person who claim to be the rightful title-owner of a trademark due to the old usage due to equitable principles of law. Concerning the topic of the study, firstly the relationship between non-registered trademark within the scope of the IPL Article 6 / 3 and the opposition of the right holder if it consists of a person's name, any other intellectual property right of another within the scope of the IPL Article 6 / 6 was evaluated and within this framework, general information was given about trade name, business name, domain name, geographical indication, design and unregistered trademark which are among the names and signs used in the commercial field. Subsequently, the question of in which cases are these names and symbols that causes to impede the registration of trademark and the reasons for invalidation in practice was examined comprehensively by objectifying it with the doctrinal discussions and the exemplary case law and the procedures to be applied to the obstacles to the registration of trademark and adept the registered trademark were discussed.
