Özet
Aile konutuna ilişkin düzenleme 4721 sayılı Türk Medenî Kanunu'nun 194. maddesinde yer alır. Söz konusu maddede aile konutu için bir tanım yer almaz. Bununla birlikte maddenin gerekçesinde“eşlerin bütün yaşam faaliyetlerini gerçekleştirdiği, yaşantısına buna göre yön verdiği, acı ve tatlı günleri içinde yaşadığı, anılarla dolu bir mekân”şeklinde bir tanım yer alır. Aile konutu, Türk toplum yapısı içerisinde önemli bir yere sahiptir. Birlikte yaşanılan konutun mülkiyetinin eşlerden birine ait olması durumunda, eşin düşüncesiz bir şekilde ya da kötüniyetli bir biçimde hareket ederek konutu devretmesinin önlenmesini sağlar. Böylece diğer eşin ve varsa çocukların zor durumda kalmaması için önleyici bir tedbir işlevi görür. Ayrıca aile içerisinde verilen kararlara diğer eşin de katılmasını sağlayarak aile ile ilgili konularda birlikte karar vermelerini, istişare etmelerini sağlayarak ailenin huzurunu korumak için bir tasarruf yetkisi kısıtlaması getirir. Bu sebeple, aile konutuna ilişkin olarak mülkiyet sahibi eşin diğer eşin rızasını almadan konutu devretmesi ya da hakları sınırlaması geçersiz olur. Aile konutuna ilişkin düzenleme sadece 194. madde ile sınırlı değildir. Türk Medenî Kanunu'nun 240, 254, 279 ve 652. maddelerinde de aile konutunun korunmasına dair düzenleme mevcuttur. Bu düzenlemeler evlilik birliğinin sona ermesinden sonraki süreç ile ilgilidir.

The regulation regarding the family residence is set forth in Article 194 of the Turkish Civil Code No. 4721. The article in question does not contain a specific definition of the family residence. However, the legislative justification of the article defines it as“a place full of memories where the spouses carry out all their life activities, shape their lives accordingly, and share their bitter and sweet days.”The family residence holds a significant place within the Turkish social structure. In cases where the ownership of the shared residence belongs to one of the spouses, it prevents that spouse from transferring the property thoughtlessly or in bad faith. Thus, it functions as a preventive measure to ensure that the other spouse and children, if any, are not left in a difficult position. Furthermore, it imposes a restriction on the power of disposition to protect the peace of the family by ensuring that the other spouse also participates in family decisions, thereby enabling them to make collective decisions and consult each other on family matters. For this reason, any transfer of the family residence or limitation of the rights over it by the owning spouse without obtaining the consent of the other spouse shall be invalid. The regulations regarding the family residence are not limited to Article 194 alone. Provisions concerning the protection of the family residence are also present in Articles 240, 254, 279, and 652 of the Turkish Civil Code. These regulations pertain to the period following the dissolution of the marital union.
