This research focuses on the procedural justice in anti-dumping investigations. The procedural rules enforced by the US and EU against China are also centred. Regarding the trade in goods, China is the primary target for both the US and EU. This study addresses three questions. The first and main question is to what extent can the procedural rules of anti-dumping investigations be used as a form of hidden trade protectionism. Secondly, this work examines whether anti-dumping investigation procedures of the US and EU support the hidden trade protectionism assumption particularly against China. Lastly, this study considers to what extent better application of principles of procedural justice would avoid the hidden trade protectionism in antidumping investigations. With reference to the first question, it is assumed that the US and EU enforce strict procedural rules to extend the protectionist effects of anti-dumping against China. Anti-dumping measures are criticised for being protective. This study argues that antidumping is not protective if procedural justice is secured so that more objective and unbiased outcomes can be achieved. However, if the investigators use legal gaps or take advantage of certain provisions to apply excessively strict procedural rules with the practical aim of imposing higher duties, then the practice is protectionist. As the Anti-dumping Agreement (ADA) has little to say on the procedural aspects of an anti-dumping investigation, World Trade Organization (WTO) members enforce their own procedural rules throughout an investigation. Most of the time, these procedures constitute a barrier for exporters. Consequently, exporters prefer not to cooperate. This, in turn, results in high anti-dumping duties which defeat the main purpose of the Agreement. The research, secondly, examines the issue of whether procedural rules in antidumping investigations are used for protectionist purposes against China. The study not only discusses the underestimated effects of procedural obstacles but also offers a new perspective in terms of international trade policy to the problem of hidden trade protectionism in accordance with empirical findings from the field. WTO lawyers, Chinese exporters and investigating authorities are surveyed to find out more about anti-dumping investigations and procedural burdens. Thirdly, it is argued that improvements in procedural justice might reduce the misuse of anti-dumping norms and practices, and thereby result in more objective outcomes while reducing the number of disputes before the Dispute Settlement Mechanism (DSM). In this context, the WTO DSM and the rules negotiations are examined to verify whether there are serious attempts to limit the misuse of antidumping measures. A revision of the ADA in the light of procedural justice is recommended. Due to the constraints on the revision of the ADA, some concrete suggestions including best practice guidelines or a standard anti-dumping questionnaire to be used by all members are proposed. The suggestions are linked to contemporary trade issues such as the US-China trade war, the crises at the Appellate Body and Regional Comprehensive Economic Partnership (RCEP). For instance, a standard questionnaire can be first adopted under RCEP which would trigger the harmonisation process of the anti-dumping procedures.
