Özet
Günümüzde temel hakları ve hürriyetleri konusu, uluslararası ve ulusal düzeyde en önemli konulardan biri hâline gelmiştir. Bu haklar aynı zamanda dünyadaki tüm halkların temel ve en önemli talebidir. Üstelik halkların haklarını ve temel hürriyetlerini kullanmalarına karşı duran diktatörlük rejimlerinin ana tehdidi olarak sayılmaktadır. Demokratik anayasalara sahip ülkeler, anayasalarında temel hak ve hürriyetlerini temel ilke olarak dâhil edilmesine genellikle büyük önem ve yer vermiştir. Dolayısıyla bu konunun gerek akademik düzeyde gerek siyasal hayat düzeyinde sahip olduğu önem yer almaktadır. Türkiye ile Çad Anayasalarının karşılaştırmalı incelenmesi, konuyla ilgili yapılan ilk çalışmadır. Bu çalışmanın kapsamı iki anayasadır. 1982 Türkiye Cumhuriyeti Anayasası ve 2018 Çad Cumhuriyeti Anayasası incelenmiştir. Aynı zamanda bu çalışma, Türk ve Çad anayasalarındaki temel hak ve hürriyetlerini yani kişinin haklarının sosyal ve ekonomik hakların siyasi hakların karşılaştırılması yapılmıştır. Ayrıca bu çalışmada daha sağlıklı bir sonuç oluşturulmak amacıyla analitik yöntem, karşılaştırma, tarih yöntemi, tasvir yöntemi kullanılmıştır. Türkiye anayasasının ikinci kısmı temel haklar ve ödevlere tahsis edilmiştir. Anayasanın 12. maddesinden 74. maddesine kadar temel hak ve hürriyetlerin hükümleri ve yaklaşık 62 anayasal maddeler ele alınmıştır. Çad Anayasa'nın 12 maddesinden başlayarak 64. maddesine kadar, Çad Cumhuriyeti yasa koyucusunun temel hak ve hürriyetler için tahsis ettiği anayasal maddelerin toplamı 52 madde olarak incelenmiştir. Bu karşılaştırmaya göre kişinin hakları, sosyal, ekonomik, kültürel ve siyasi hak ve hürriyetlerle ilgili anayasal maddeleri yaptığımız karşılaştırmada Türkiye ile Çad anayasalarında temel hak ve hürriyetler arasında çok büyük bir benzerlik olduğunu görülmektedir. Ayrıca iki anayasadaki temel hak ve hürriyetlerle ilgili anayasa maddelerinde farklıklar var olduğu sonucuna ulaşılmıştır.

Today, the issue of fundamental rights and freedoms has become one of the most important issues at the international and national level. These rights are also the basic and most important demand of all peoples of the world. Moreover, it is counted as the main threat of dictatorial regimes that oppose peoples' enjoyment of their rights and fundamental freedoms. Countries with democratic constitutions have generally given great importance and place to the inclusion of fundamental rights and freedoms as a basic principle in their constitutions. Therefore, the importance of this subject both at the academic level and at the level of political life is located. Comparative analysis of the Constitutions of Turkey and Chad is the first study on the subject. The scope of this study is two constitutions. The 1982 Constitution of the Republic of Turkey and the 2018 Constitution of the Republic of Chad were examined. At the same time, this study compares the fundamental rights and freedoms of the Turkish and Chad constitutions, namely the rights of the individual, social and economic rights, and political rights. In addition, analytical, comparison, historical and descriptive methods were used in this study in order to create a healthier result. The Turkish constitution allocates fundamental rights and duties in its second part. From article 12 to article 74 of the Constitution, the provisions of fundamental rights and freedoms and about 62 constitutional articles are discussed. Starting from the 12th article of the Chad Constitution to the 64th article, the sum of the constitutional articles allocated by the legislator of the Republic of Chad for fundamental rights and freedoms has been examined as 52 articles. According to this comparison, when we compare the constitutional articles related to the rights of the person, social, economic, cultural and political rights and freedoms, it is seen that there is a great similarity between fundamental rights and freedoms in the Constitutions of Turkey and Chad. In addition, it has been concluded that there are differences in the constitutional articles related to fundamental rights and freedoms in the two constitutions.
