Climate change has been worsening day by day. Urgent measures have to be taken in order to mitigate climate change before the irreversible damages occur. One of the significant factors that can mitigate climate change is renewable energy. In order to increase renewable energy capacity, states need private investors in the renewable energy sector. Although the cost of renewable energy technologies has been reducing, because they are still less cost-effective than high-carbon emitters, and the profits of investment can be got in long-term, states have to lure attractive incentives for renewable energy investors, such as granting feed-in tariff schemes. While states grant attractive incentives for renewable energy investors, unless support mechanisms are well-planned, states might face significant fiscal or technological capacity problems. Due to these problems, states are likely to change or withdraw these incentive programs given as a manner that impair investors rights that are granted by International investment agreements(IIA) and contracts. At this point protection standards in IIAs and the right to regulate of states for public interest competes. The balancing two competing interest in the renewable energy sector is a difficult task for arbitral tribunals and international community. There are different factors that can affect each other. Up to date, four arbitration cases related to withdrawal of incentives have been rendered, many renewable energy casesare pending in several arbitration tribunals. These awards can be a roadmap for pending cases, and they can trigger taking measures that can promote renewable energy investments.
