Evidence taking process is a key part of international arbitration proceedings. Without adequate evidence, an arbitrator cannot establish the facts of the case; and render a fair award. On the other hand, some parties/non-parties may be unwilling to produce evidence, considering the requested evidence might be unfavourable for their cases. At this point arbitrators cannot compel parties/non-parties since they lack the authority to compel them to produce evidence. However, there are alternative means which enables arbitrators to obtain evidence from non-cooperative parties. This study will first examine the sources of arbitrators' powers in terms of evidence taking. In this regard, statutory laws of France and US and set of rules, which supplements evidence taking process, will be examined. Next, means of taking evidence will be presented. At this point, evidence taking procedures of French and US laws and their efficiencies will be compared. Each national law provides certain advantages and drawbacks in different aspects. Therefore, depending on the circumstances, either French or US law may provide a more efficient way of taking evidence. At the end of each section, by adopting socio-legal methodology, impacts of evidence taking methods will be discussed. It will be argued that, depending on the scenario, some evidence taking methods might be more useful than others.
