Özet
Arbitration is a dispute resolution method that is based on the consent of the parties. The sine qua non of this method is the arbitration agreement. In the context of developing modern international business transactions that involve multi-layered legal obligations and participation of several entities can be problematic when a dispute has arisen. In order to solve the disputes, the arbitration agreement may be extended to non-signatories under certain circumstances although the nonsignatories do not consent explicitly to the arbitration agreement. Therefore, the extension of the arbitration agreement is a tool to determine the consent whereas the explicit parties of the arbitration agreement are the only parties who have consent. The aim of this thesis is to analyze the approach of the four different jurisdictions of England, France, Switzerland, and Turkey on the extension of the arbitration agreement to non-signatories. The analysis will focus on whether the arbitration agreement may be extended considering the implied consent, group of companies doctrine, and piercing the corporate veil in the selected jurisdictions.
