Özet (Çeviri)
In this dissertation, first of all, I tried to expose the legal insight of the selfdetermination dispute in Crimea to find the legal facts about this case. Secondly, I tried to propose a possible solution mechanism to resolve this dispute. In the light of my proposal, I tried to discuss the structure of UN interim administration in terms of legality of this mechanism and its applicability in the case of Crimea. In the first chapter I tried to give broad information about the history of the case of Crimea. Then, in the second chapter, I tried to present the conflicting claims of parties of this dispute. Then in the second section of this chapter I tried to examine the general theory of selfdetermination to reveal the legal facts about this dispute. Then I drew a conclusion about the legal fact is that Crimea is the integral part of Ukraine and Russia's use of force was in violation of the UN Charter. On the other hand, before the annexation, Ukraine regime did not recognize broad autonomous rights to local people of Crimean Peninsula in terms of internal self-determination. Thus, it can be concluded that, Crimea should be the integral part of Ukraine but also, Ukraine has obligation to recognize broad autonomous rights to local people of Crimea including Russians and Tatars under the international law within its administrational regime. In the last chapter, I tried to evaluate the legality of the UN interim administration structure and its applicability to Crimea case. I drew a conclusion that notwithstanding the existence of doubts about the legality of this administration, it might be possible solution for resolving this dispute in that territory. In my dissertation, I used the methods of doctrinal analysis, comparative, historical and socio-legal research methodologies during the my research.
