Tezin konusu Makasıdı Şeria teorisinin teorik kökenlerini Hanefi fakih Ebu Bekir Al-Cessas'ın eserlerinde aramaktır. Tez üç ana bölümden oluşmaktadır. Birinci bölüm Cessas'ın ve eselerinin tanıtımını, makasıd teriminin farklı anlamları açıklanıp tartışılmasını içeren alt başlıklardan oluşur. Genel anlamda tezin konusuna hazırlık olarak tasarlanmıştır. İkinci bölüm fıkıh usulünün farklı konularının makasıdı şeria teorisiyle ilgisi açıklanmış usul alimlerinin ihtilaflarında bu teoriyle uyuşan görüşün hangisi olduğu ve Cessas'ın bu tartışmalarda nerede durduğu tespit edilmeye çalışılmıştır. Cessas'ın ele aldığı tüm usul konularını içerir. Üçüncü ve son bölümde ise makasıd teorisinin teorik temelleri ve bu temellerle ilgili teorik sorunlar tartışılmıştır. Fıkıh usulünün yapısı, alternatif yaklaşımlar, hüsün-kubuh tartışması, maslahat ilkesinin geçerliliği ve sınırları, beyan ilkesi, lafız-mana ilişkisi, asıl mana- yan mana ayrımı, icazı Kur'an, teşri 'in mucize yönü gibi teorik tartışmalar bu konuların başlıcalarıdır. The subject of the thesis is to seek the theoretical origins of the Makasidi Sharia theory in the works of Hanafi jurist Abu Bakr Al-Jassas. The thesis consists of three main parts. The first chapter consists of sub-headings that include the introduction of Jassas and his works, and the explanation and discussion of the different meanings of the term Maqasid. In general, it is designed as a preparation of the thesis. In the second part, the relevance of different subjects of fiqh method with the theory of makasidi sharia has been explained, and it has been tried to determine which view is compatible with this theory in the disputes of the scholars of the method and where Jassas stands in these discussions. It includes all the procedural issues that Jassas deals with. In the third and last chapter, the theoretical foundations of the benefit (maşlaha) theory and the theoretical problems related to these foundations are discussed. Theoretical discussions such as the structure of the method of fiqh, alternative approaches, the discussion of husn-kubuh, the validity and limits of the principle of maslaha, the principle of bayan, the relationship between wording and meaning, the distinction between main meaning and connotation, the ijaz of Qur'an, and the miraculous aspect of Islamic law are the main topics.
