In this study, i discussed the topic of the independence of the Prophetic Tradition in the derivation of religious rulings; with the intention to explain its concept, the obligation upon us to use it as textual proof, the different schools of thoughts among the scholars regarding the permissibilty of its independence in derivation as well as how it can be used as a textual proof; in addition to explaining a few modern examples as an application of this issue that are used as proofs for the opinions held by each of the people who view the permissibilty of the independence of the Prophetic Tradition in the derivation of religious rulings as well as the people who reject the permissibilty of this matter respectively. I have utilised the descriptive-critical analysis research methodology in explaining the concept of the independence of the Prophetic Tradition in the derivation of religious rulings and the things that are related to it, as well as in presenting the views of the scholars and their schools of thoughts with regards to the permissibility of its independence, and in discussing all of them. And i have utilised the comparative research methodology in comparing between these different schools of thoughts of these scholars and their proofs. Hence my study comprises of an introduction, two chapters and a conclusion. The first chapter explains the concept of the independence of the Prophetic Tradition in the derivation of religious rulings as well as the schools of thoughts of the scholars regarding its permissibility, and a refutation towards those who reject the dependence on it as textual proof. The second chapter is a detailed study of the modern examples that are used as proofs by those who view the permissibilty of the independence of the Prophetic Tradition in the derivation of religious rulings as well as the modern examples that are used as proofs by those who reject its permissibility, but rather view it as something to explain the Quran and that it must be referred back to the Quran which is the main source of religious rulings. The most important thing that can be concluded from my study is that“the independence of the Prophetic Tradition in the derivation of religious rulings”, according to the majority of the scholars, refers to every matter that the Holy Quran neither mentions nor does it explain regarding their rulings as to whether they are impermissible or permissible, regardless whether there is a general reference regarding it in the Quran or not. And all the eighteen examples mentioned by Imam Ash-Shatibi have been proven that they can be referred back to a main point of origin in the Quran, except one example. And likewise, all that Imam Ibn Al-Qayyim has mentioned too can also be referred back to a main point of origin in the Quran. ٕٕ7 And the majority of the scholars have agreed with Imam Ash-Shatibi regarding what he has mentioned of these examples: that they regarded them as an explanation (to what is in the Quran), and that it can be referred back to a main point of origin regarding it in the Quran; except that Imam Ash-Shatibi tried hard not to term them“independence”but instead to include them under the term“explanation”; so he traversed a detailed path, and he strove and searched for deeper meanings and common points that are shared between what is mentioned in the Quran and in the Prophetic Tradition. Hence, he then interpreted the rulings made by the Prophet peace be upon him to be a matter that followed the Quran through either of these two: either through having a common point with it, or through having the same meaning; and he viewed the view of the majority of the scholars to be more accurate, such that there is no logical preventor from there being rulings in the Prophetic Tradition that were passed by the Prophet peace be upon him independent from the Quran; as well as that there is no contradiction between the fact that the Prophetic Tradition explains what is in the Quran and the fact that it adds on upon what is mentioned in the Quran or that it can contain rulings that are not mentioned in the Quran; and that the religious proofs allow for that; and that there are examples of religious rulings in the Prophetic Tradition that do not refer back to a main origin in the Quran which mentions them, except the general main origin present in the Quran regarding the order to obey the Prophet peace be upon and to follow his Sunnah
