Özet
Eski Yunan felsefesindeki pek çok kavramın kökü şiire kadar uzanmaktadır. Elinizdeki çalışmanın amacı, Platon öncesi felsefede ortaya çıkacak olan hukuki düşüncenin kökenini Homeros, Hesiodos ile Solon'un şiirlerinde açığa çıkartmaktır. Bu açıdan tezin kapsamı, Homeros, Hesiodos ile Solon'da hukuka ilişkin olarak geçen“themis,”“dikē,”“nomos”ile“thesmos”sözcüklerini çözümlemektir. İlgili sözcükleri, tümdengelime dayanan köken bilimsel bir yöntem yerine, tümevarımda temellenen anlam bilimsel bir yöntemle irdeleyeceğiz. İncelememizin ana sonucu, Homeros'un düzen temelli olarak iye olduğu hukuki anlayış biçiminin, Hesiodos aracılığıyla Solon'da hukuk kavramına doğru dönüşmesidir. Adı geçen ozanlar, ilgili sözcükleri ne tek bir özü olan genel, tümel ve soyut kavramlar olarak ne de sonraki zamanlarda kazanacağı anlamlarda kullanmışlardır. Bu nedenle söz konusu sözcüklerin her bir belirişini bağlamlarıyla birlikte ele almak bir gerekliliktir. Bugüne dek, Homeros Hesiodos ile Solon hukuki düşünce bakımından bir arada değerlendirilmemiştir. Araştırmamız bu konudaki boşluğu doldurmaya yönelmektedir.

The roots of many concepts in the Greek philosophy can be traced back to the poetry. The aim of the thesis is to reveal the origin of the ancient legal thought that will emerge in pre-Platonic philosophy in the poems of Homer, Hesiod and Solon. In this respect, the scope of the examination is to analyze the legal words“themis,”“dikē,”“nomos”and“thesmos”in Homer, Hesiod and Solon. We will examine the words in question with a semantic method based on induction, instead of an etymological method based on deduction. The main result of our research is the transformation of the order-based legal understanding of Homer to the concept of law in Solon through Hesiod. The poets used the words aforementioned neither as general, universal and abstract concepts with a single essence, nor in the meanings that they will gain in later times. For this reason, it is a necessity to consider each occurrence of the words along with their contexts. Until now, Homer, Hesiod and Solon have not been evaluated together in terms of legal thought. Our study aims to fill this gap. Les racines de nombreux concepts de la philosophie grecque remontent à la poésie. L'objectif de la thèse est de révéler l'origine de la pensée juridique antique qui émergera dans la philosophie préplatonicienne dans les poèmes d'Homère, d'Hésiode et de Solon. À cet égard, l'objet de l'examen est d'analyser les mots juridiques“themis,”“dikē,”“nomos”et“thesmos”chez Homère, Hésiode et Solon. Nous examinerons les mots en question avec une méthode sémantique basée sur l'induction, au lieu d'une méthode étymologique basée sur la déduction. Le principal résultat de notre recherche est la transformation de la compréhension juridique basée sur l'ordre d'Homère en concept de droit chez Solon à travers Hésiode. Les poètes n'ont utilisé les mots ni comme des concepts généraux, universels et abstraits avec une seule essence, ni dans les significations qu'ils prendront dans les temps ultérieurs. Pour cette raison, il est nécessaire de considérer chaque occurrence des mots avec leurs contextes. Jusqu'à présent, Homère, Hésiode et Solon n'ont pas été évalués ensemble en termes de pensée juridique. Notre étude vise à combler cette lacune.
