Özet
Rekabet Kurulunun son dönemde yürüttüğü soruşturmalar ve verdiği Zincir Market Kararı ile hub and spoke bilgi değişimi (topla-dağıt bilgi değişimi) konusu yeniden gündeme gelmiştir. Temel itibarıyla unsurları ve böyle bir ihlalin varlığının ortaya konulması için gereken ispat standardı Amerika Birleşik Devletleri ve Birleşik Krallık otoritelerinin verdiği kararlar ile şekillenmiştir. Nitekim Rekabet Kurulu da bu yaklaşımı Bilgisayar ve Oyun Konsolları Kararında uygulamıştır. Rekabet Kurulu tarafından hub and spoke iddiası üzerine verilen son karar olan Zincir Market Kararında ise Portekiz Rekabet Otoritesinin yaklaşımına atıfta bulunularak bir karar verilmiş ve bu karar dahilinde Birleşik Krallık yaklaşımına dair herhangi bir atıfta bulunulmamıştır. Bu yönüyle kararda Rekabet Kurulunun yaklaşım değiştirdiği değerlendirilmektedir. Bu tezin konusunu da hub and spoke ihlalin şartları ve bu ihlal tipinin ispatı için sağlanması gereken ispat standartları oluşturmaktadır. Bu hususlar ortaya konulurken Birleşik Krallık, ABD, Portekiz ve Almanya otoritelerinin verdiği kararların yanında Rekabet Kurulunun bu zamana kadar verdiği dört karardan yararlanılacaktır. Bu kararlar ışığında ise hub and spoke ihlalin ortaya konulabilmesi için gerekli ispat standardının ne olması gerektiği sonucuna ulaşılacaktır.

With the recent investigations conducted by the Competition Board and the Chain Market Decision, the issue of the hub and spoke information exchange has come to the agenda again. Its elements and the standard of proof required to establish the existence of such an infringement have been shaped by the decisions of the United States and the United Kingdom authorities. The Competition Board applied this approach in its Decision on Computer and Game Consoles. In the Chain Market Decision, which is the last decision of the Competition Board on the hub and spoke allegation, the Competition Board decided by referring to the approach of the Portuguese Competition Authority and did not make any reference to the United Kingdom approach. In this respect, it is considered that the Competition Board has changed its approach. The subject of this thesis is the conditions of the hub and spoke infringement and the standards of proof required to prove this type of infringement. In this thesis, the decisions of the authorities in the UK, the USA, Portugal, and Germany, as well as the four decisions of the Competition Board so far, will be utilized. In light of these decisions, it will be concluded what the necessary standard of proof should be to establish hub and spoke infringement.
