Özet
The main question that the research seeks to answer is“are renewable-energy support schemes creating barriers to the free movement of goods in the EU single market?”. Considering that the topic has both legal and political aspects, and precise conclusions that are true according to everyone would not be deduced from the topic, the research takes an inductive approach to the issue. As the topic is not convenient to conduct qualitative and quantitative research methods, this research is conducted by secondary research. The main methods used are regulation and literature review. The data acquired by reviewing legal foundations and literature on the topic is going to be analysed and interpreted. In order to answer the research question, economic statistics such as the share of renewable energy in the EU and intra-EU energy trade are included; however, the detail of existing intra-EU energy trade statistics is not enough to reveal to what extent the barriers to free movement of goods emerging from the national renewable energy schemes have an economic impact. Therefore, the cases before the national courts and the Court of Justice of the European Union (CJEU) has been taken as proof that national renewable energy support schemes create barriers to free movement of goods, whereas, this situation has been justified by the CJEU on the basis of protection of the environment. Given that free movement of goods is an essential component of the single market, the research suggests that European institutions keep in mind that harmonisation of renewable energy support schemes with EU law would serve to find balance in the aforementioned quandary if the appropriate policy instruments are used in future regulations.
