Özet

Bu çalışma, hicrî ilk beş asırda Hanefilerde fesad teorisini tespit etmeyi hedeflemektedir. Ayrıca, Hanefilerin bu teorinin özel hukuktaki konumunu belirlemeyi amaçlamaktadır. Özel hukuk düşüncesindeki fesad terimine benzer olan hükümsüzlük anlayışına odaklanmak için iki hukuk sistemi seçtik. İlk olarak, özel hukuk sisteminin temelini teşkil eden Roma hukuku sistemi, ikinci olarak ise modern özel hukuk görüşünü yansıtan ve günümüzdeki durumunu temsil eden Türk hukukudur. Hicrî ilk beş asırdaki Hanefilerin fesad teorisini tespit etmek için kronolojik olarak Kerhi ve Cessâs'ın fesad anlayışına odaklandık. Ardından, bu dönemdeki en kapsamlı fesad teorisini oluşturan Debûsî'nin anlayışını açıkladık. Debûsî, fesad kavramını oldukça geniş bir şekilde ele almıştır. Fesad teorisini temellendirmek için Debûsî, iki temel unsuru ortaya koymuştur: Birincisi, şeri varlık kavramını oluşturmak, ikincisi ise sebep-sonuç ilişkisi ilkesini kurmaktır. Bu şekilde, hicrî ilk beş asırda Hanefi hukuk doktrininde geliştirilen fesad teorisi ile ilgili düşünce birikiminin özel hukuktaki hükümsüzlük düşüncesindeki konumunu ve sağlayabileceği katkıyı incelemiş olduk.

This study aims to identify the theory of fasad in contracts among the Hanafi scholars during the first five centuries of the Hijri calendar. Additionally, it aims to determine the position of this theory within private law as understood by the Hanafi school. To focus on a similar concept to fasad in private legal thought, we selected two legal systems. First, we chose Roman legal system, which forms the foundation of the private law system, and second, we chose Turkish law, which reflects modern private legal thought and its current state. To identify the theory of fasad among the Hanafi scholars during the first five centuries of the Hijri calendar, we focused chronologically on the understanding of fasad by Karhi and Jassas. Subsequently, we explained the comprehensive theory of fasad developed by Dabusi. Dabusi extensively addressed the concept of fasad. To establish the theory of fasad, Dabusi presented two fundamental elements: First, to establish the concept of legal (shar'i) existence, and second, to establish the principle of cause and effect. In this way, we examined the position and potential contributions of the accumulated thoughts on the theory of fasad developed within the Hanafi legal doctrine during the first five centuries of the Hijri calendar in relation to the concept of nullity in private law.
