Özet
Siyaset felsefesinin temel konularından birisi olan ve Türk devlet yapısında karşılık bulduğu düşünülen güçler ayrılığı ilkelerinin ele alındığı bu çalışma; gücün, sistematiksel olarak yasama, yargı ve yürütme gibi ayrı kulvarlarda konumlandığı ve her bir güç unsurunun farklı organlarla temsil edildiğine işaret edilerek, ilkelerin yürürlüğüne ilişkin olarak farklı açılımlarda bulunulmuştur. Gücün muhatabının insan ve toplum, elinde bulunduranın ise yönetimsel anlamda devletin veya iktidarın olması nedeniyle bu her üç güç unsuru değerlendirme konusu yapılmıştır. Gücün kullanımına yönelik tarihi seyir ve gücün paylaşımının zorunluluğuna ilişkin düşünsel arka boyut, fikri ileri sürenler nezdinde incelenmiştir. Türk toplum ve devlet yapısında geçmişten günümüze gücün kullanımına ilişkin değerlendirmeler yapılmıştır. Gücün devlet aygıtı bağlamında idarenin meşruiyeti, devletin rejimi ve yönetenin ideolojisi ele alınarak kullanımı konu edilmiştir. Türk Milleti'nin çağdaşlaşma anlamında Batı uygarlığını takip ve yakalama çabası, bu çabayı ıslahat düzleminde birbirini takip eden süreçler içerisinde; Tanzimat, Islahat ve Meşrutiyet gibi denemelerle ele alması ve Cumhuriyet'te karar kılması mevzu edilmiştir. Gücün kullanımı bağlamında bu rejimsel farklılıklar ve anayasal süreçler konu edilerek krizler, darbeler, tıkanmalar üzerinde durulmuştur. 1982 Anayasası'nda yapılan değişikliklerle parlamenter sistemden partili cumhurbaşkanlığı modelinin benimsendiği Cumhurbaşkanlığı Hükümet Sistemi'ne geçişe ilişkin değerlendirmelerde bulunulmuştur.

This study deals with the principles of separation of powers, which is one of the fundamental issues of political philosophy and thought to be reflected in the Turkish state structure; Pointing out that the power is systematically located in separate branches such as the legislature, the judiciary and the executive, and that each element of power is represented by different organs, different explanations have been made regarding the enforcement of the principles. Since the addressee of power is people and society, and the one who holds it is the state or the government in the administrative sense, all three elements of power have been evaluated. The historical course regarding the use of power and the intellectual background regarding the necessity of sharing power have been examined by those who put forward the idea. Evaluations have been made regarding the use of power in the Turkish society and state structure from past to present. The use of power in the context of the state apparatus is discussed by considering the legitimacy of the administration, the regime of the state and the ideology of the ruler. The Turkish Nation's effort to follow and catch up with Western civilization in terms of modernization, this effort in successive processes on the reform level; It was discussed that it should be discussed through experiments such as tanzimat, reform and constitutionalism and decided on the republic. In the context of the use of power, these regime differences and constitutional processes are discussed and crises, coups, and blockages are emphasized. Evaluations were made regarding the transition from the parliamentary system to the Presidential System of Government, in which the party presidential model was adopted, with the amendments made to the 1982 Constitution.
